WHEREAS, ORS 275.100 provides that the Board of County Commissioners declare
its intention to exchange real property by proper resolution; and
WHEREAS, a hearing shall be held for the purpose of receiving objections to the
proposed exchange of real property; and
WHEREAS, Deschutes County intends to exchange real property with Diane C.
Marshall-Gokey and other parties; and
WHEREAS, the parties may equalize values between the exchange properties by means
of cash payment; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That Deschutes County intends to transfer the real property described as:
Parcel 1
W'/a SW'/4 NE'/4 and W1/2E l/a SW'/4 NE'/4, Sec. 24, Twp. 17 S., Range 12 E.,
W.M., Deschutes County, Oregon (30 acres more or less). Less the Southerly
60 feet dedicated public way.
Parcel 2
W1/2E l/z SW'/4 NE'/4, Sec. 24, Twp. 17 S., Range 12 E., W.M., Deschutes County,
Oregon, less the southerly 60 feet dedicated public way.
Parcel 3
A parcel of land located in the NW'/4 of Section 21, Township 17 South, Range
12 East, W.M., Deschutes County, Oregon more particularly described as
follows:
Commencing at the NW Corner of Lot 13 of Sherman Park (CS 9721); thence
S30000'39"E 13.27 feet along the West line of said Lot 13 to a point on the
South 40.0 foot right-of-way line of Empire Avenue, said point being the Point

of Beginning; thence, leaving said West line and along said South 40.0 foot right-
of-way line 94.10 feet along the arc of a 1185.92 foot radius non -tangent curve
to the left, the long chord of which bears S79°32'15"E 94.07 feet; thence,
S81048'38"E 57.28 feet to a point on the West right-of-way line of the Bend
Parkway; thence, leaving said South 40.0 foot right-of-way line and along said
West right-of-way line S13°47'31"E 166.49 feet to a point on the centerline of
a Deschutes Irrigation and Reclamation Co. canal lateral (as shown on said Plat
of Sherman Park); thence, leaving said West right-of-way line and along said
canal centerline S63°32'04"W 70.21 feet to the SW Corner of said Lot 13;
thence, leaving said canal centerline and along said West line of Lot 13
N30000'39"W 252.01 feet to the Point of Beginning.
Subject to the permanent slope easement described as PARCEL 4 in Oregon
Department of Transportation right-of-way file no. 6142-558.
The land to be transferred by Diane C. Marshall-Gokey is described as follows:
Lot 1, Block 3, NORTH ADDITION TO BEND, Deschutes County, Oregon.
Section 2. A hearing for the purpose of receiving objections to the above land trade will
be held at 10:00 a.m. on Wednesday, August 23,1995, in Hearings Room "A," of the Deschutes
County Juvenile Justice Building, Bend.
Section 3. That the Clerk of the County Court shall give notice of the time and place
for the hearing set in Section 2 of this Resolution by publication of the notice marked Exhibit
"A," attached hereto and by this reference incorporated herein, in "The Bulletin" once each
week for four consecutive weeks prior to the date of such hearing.

On Wednesday, August 23, 1995, at 10:00 a.m. in Hearings Room "A," of the Deschutes
County Juvenile Justice Building, 1128 N.W. Harriman, Bend, Oregon, the Board of County
Commissioners of Deschutes County, Oregon, will hold a hearing on an exchange of real
property from Deschutes County to Diane C. Marshall-Gokey and other parties. The real
properties to be transferred by Deschutes County is described as follows:
