Marshall-Gokey and Other Parties, and Making the Required Findings. � �J' 014 1 563 ORDER NO. 95-133 WHEREAS, Resolution No. 95-109 provided for a hearing for the exchange of property between Deschutes County and Diane C. Marshall-Gokey and other parties; and WHEREAS, said hearing was\leld'on August 23, 1995; and WHEREAS, ORS 275.100 requires that the Board of County Commissioners authorize the exchange of lands after hearing by order; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS and finds as follows: Section 1. That the real properties to be exchanged are described below: The lands to be transferred by Deschutes County are generally described as follows: Parcel l W'/a SW'/a NEl/a and W1/2E l/a SW1/a NEl/a, Sec. 24, Twp. 17 S., Range 12 E., W.M., Deschutes County, Oregon (30 acres more or less). Less the Southerly 60 feet dedicated public way. Parcel 2 W'/z El/a SWI/4 NEI/a, Sec. 24, Twp. 17 S., Range 12 E., W.M., Deschutes County, Oregon, less the southerly 60 feet dedicated public way. t� KED' Parcel 3 A parcel of land located in the NWI/a of Section 21, Township 17 South, Range 12 East, W.M., Deschutes County, Oregon more particularly described as follows: Commencing at the NW Corner of Lot 13 of Sherman Park (CS 9721); thence S30000'39"E 13.27 feet along the West line of said Lot 13 to a point on the South 40.0 foot right-of-way line of Empire Avenue, said point being the Point of Beginning; thence, leaving said West line and along said South 40.0 foot right - PAGE 1 OF 7 - ORDER NO. 95-133 (8/23/95) 0..i 4 0 -1 50.11 of -way line 94.10 feet along the arc of a 1185.92 foot radius non -tangent curve to the left, the long chord of which bears S79°32'15"E 94.07 feet; thence, S81048'38"E 57.28 feet to a point on the West right-of-way line of the Bend Parkway; thence, leaving said South 40.0 foot right-of-way line and along said West right-of-way line S13°47'31"E 166.49 feet to a point on the centerline of a Deschutes Irrigation and Reclamation Co. canal lateral (as shown on said Plat of Sherman Park); thence, leaving said West right-of-way line and along said canal centerline S63°32'04"W 70.21 feet to the SW Corner of said Lot 13; thence, leaving said canal centerline and along said West line of Lot 13 N30000'39"W 252.01 feet to the Point of Beginning. Subject to the permanent slope easement described as PARCEL 4 in Oregon Department of Transportation right-of-way file no. 6142-558. The lands to be transferred by or on behalf of Diane C. Marshall-Gokey, are generally described as follows: Lot 1, Block 3, NORTH ADDITION TO BEND, Deschutes County, Oregon. Section 2. That the exchange of real properties shall be equalized by payment of $14,000 cash from Deschutes County to Diane C. Marshall-Gokey, or her assigns. Section 3. That the exchange of the real property herein described is in the best interest of Deschutes County. Section 4. That upon review and approval of title by Deschutes County Legal Counsel the exchange of real property as referenced is hereby authorized. Section 5. The Deschutes County Property Manager is authorized to take those actions reasonably calculated to complete the referenced exchange. The Deschutes County Treasurer is herein authorized to disburse $14,000 cash at closing from fund 0145-3655 to facilitate said exchange. DATED this & day of , 1995.
