WHEREAS, the Board of County Commissioners by its Order 92-130
imposed a lien in accordance with law for an assessment in the amount
of $2,898.00 on Lot 17, Ponderosa Cascades, also known as Tax Lot'16-
10-01-CO-2900 (subject property) for local improvements benefitting the
subject property; and 014

WHEREAS Order 92-130 was recorded by the Deschutes County Clerk in
the Assessment Lien Docket and the lien for the local improvement
assessment on the subject property was recorded as a local improvement
district assessment lien in said Assessment Lien Docket in Volume 92
Page 38980; and
WHEREAS, the then owner of the subject property applied to pay the
assessment lien in installment payments (a copy of the application is
attached hereto as Exhibit A and incorporated herein by reference) set
forth as allowed under law and by Order 92-130; and
WHEREAS, the lien on the subject property was released in error
before the assessment was paid off in full; and
WHEREAS, DCC 12.48.275 allows for reinstatement of liens released
in error, and reinstatement is necessary to ensure that full payment of
the assessment on the property is received; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. Pursuant to DCC 12.48.275, the lien for the assessment
for local improvements on Lot 17 Ponderosa Cascades Subdivision, a Plat
recorded at Cabinet A, Page 577 of the Deschutes County Records
(subject property) first imposed on the subject property by Order 92-
130 is hereby reinstated and imposed on the subject property in the
full amount of the lien as stated in Order 92-130 as if the lien had
never been released.
Section 2. The County Clerk shall, upon the filing of this Order,
record and index it upon the lien docket of Deschutes County known as
Assessment District Liens. The lien docket shall reflect the following
information:

(The lien amount reflects the amount of the actual final costs of the
subject local improvements as apportioned among the benefitted
properties and does not reflect any payments made against the
assessment since the time the assessment lien was initially imposed.)
Section 3. Upon filing in the appropriate lien docket the lien
for the assessment is reinstated on the subject property.
Section 4. Notice of this reinstatement shall be sent to the
owners of the subject property.

APPLICATION TO FINANCE IMPROVEMENT FOR
PONDEROSA CASCADE LOCAL IMPROVEMENT DISTRICT
(BANCROFT BONDING ACT, ORS 223.205 TO 223.300)
TO THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
Pursuant to the provisions of the Act of the Legislature of the State of
Oregon, known as the "Bancroft Bonding Act", (ORS 223.205 to 223.300, as
amended), applicant makes application to finance the portion of the cost of
the road improvement levied against applicant's property and being part of
the improvement of roads.in unincorporated Deschutes County, Oregon, as the
same has been determined and assessed by the Board of County Commissioners
of Deschutes County, Oregon, and order No. 92-130, and docketed upon the
Docket of Assessment District Liens of Deschutes County, Oregon.
The applicant and property owner of the property described below does
hereby waive all irregularities or defects, jurisdictional or otherwise, in
the proceedings to cause said improvement to be constructed or made for
which the assessment is levied, and in the apportionment and assessment of
the cost thereof, and acknowledges that applicant is indebted and the
property legally charged with the assessment.
Applicant agrees to pay the assessment in twenty (20) or fewer semi-annual
installments, together with interest at nine percent (9%) per annum on all
unpaid assessments. The interest shall be paid semiannually in addition to
and at the time each principal payment is made.
The installments shall be due and payable on the 1st day of April, 1993,
the first day of October, 1993, and thereafter on the 1st day of April and
the 1st day of October in subsequent years.
Applicant is the owner of the following -described property against which an
