9542466 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Approving and Confirming the Sale of Certain Real Property Acquired by Deschutes County. ORDER NO. 95-173 0148=1.355 WHEREAS, Deschutes County has acquired title to certain real property pursuant to a variety of means, including real property tax foreclosure proceedings on file in the Circuit Court of the State of Oregon for Deschutes County; and WHEREAS, the Deschutes County Board of Commissioners did adopt Order No. 95- 140 on October 4, 1995, and Order No. 95-162 on November 8, 1995, ordering the Deschutes County Sheriff to offer for sale the real property described in Exhibit "A," attached hereto and by this reference incorporated herein; and WHEREAS, the Deschutes County Sheriff did offer for sale that real property described in Exhibit "A" on November 9, 1995, in the building which formerly housed the Bend Armory of the Oregon National Guard at 204 N.W. The Deschutes County Office of Legal Counsel is directed to prepare bargain and sale deeds for those properties sold for cash and that promissory notes and trust deeds be prepared for those properties sold on terms as described in Exhibits 'B," and "C," to be signed by the Board of County Commissioners. Section 3. That the Deschutes County Treasurer is directed to pay any and all Local Improvement District liens on those real properties shown as sold and listed in Exhibits "B," and "C", along with any costs associated with the forgoing sale from the proceeds listed in Exhibits "B," and "C". Section 4. That the Sheriffs sale authorized by Orders No. 95-140 and 95-162 is hereby confirmed and closed. Section 5. Offers may be made through a licensed real estate agent. The County shall pay a five percent (5%) real estate commission to licensed real estate agents who appear at the sale on behalf of a client whose bid is accepted by the Board of County Commissioners. Commissions shall not be paid to realtors representing themselves or any entity in which they have a financial interest. Realtors who wish to appear at the auction on behalf of a client and therein be eligible for a real estate commission shall register on November 6 and 7, 1995, at the Property Management Office, 1340 N.W. Wall Street, Bend, Oregon and provide a photocopy of their current real estate license to County personnel. Commissions will not be paid unless the realtor pre -registers and provides the required documentation at the time of registration. All parcels are sold as is. Potential bidders should thoroughly investigate all aspects of a property prior to bidding. Deschutes County does not guarantee or warrant that any parcel is buildable, suitable for septic system, has legal access, is vacant or is usable for any particular purpose. The County shall not warrant or defend the fee simple title of real property offered for sale to be free of defects or encumbrances, but will only sell and convey such interest as the County acquired by foreclosure or other means and holds at the time of sale.
