and Declaring an Emergency. (�
ORDINANCE NO. 95-076 014�-� :t
WHEREAS, the City of Redmond has requested that the County modify
existing Redmond Urban Area ordinances to allow the County Community
Development Department to implement a grid street policy on land use
applications outside the City limits but within the Redmond Urban
Growth Boundary; and
WHEREAS, a public hearing was held, after notice was given in
accordance with law, before the Redmond Urban Area Planning Commission;
and
WHEREAS, the Redmond Urban Area Planning Commission recommended
approval of the Redmond Urban Area ordinance changes to the County
Board of Commissioners; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDAINS as follows:
Section 1. The third paragraph of Page 16 of the General Land Use
Element of the Redmond Urban Area Comprehensive Plan is amended to read
as follows:
"Future development can recognize the preferred single-family
housing development in a variety of forms. One of the more
significant aspects of residential neighborhoods is the
street pattern. [The street system in new areas should be
designed so that it provides easy access to each lot from
collector streets and does not encourage traffic movement
through quiet residential neighborhoods.] The principal
function of local residential streets is to provide access to
the homes along the residential street they serve; a
secondary function is to provide for circulation within a
neighborhood. Residential streets should serve neighborhood
protection and quality of life objectives. They should
permit comfortable and safe pedestrian and bicycle movements
for vulnerable users such as children, the elderly and
disabled, as well as motorized vehicular movements.
Residential streets should accommodate convenient and
efficient pick-ups and deliveries, emergency access (fire,
police, ambulance, and maintenance services) and where
densities justify, bus or paratransit services. Residential
streets should also enhance the overall aesthetics of the
neighborhood through well-designed layout and street
landscaping. Street alignments should also provide easy
access to each lot from collector streets and does not

encourage traffic movement through quiet residential
neighborhoods. Street alignments should also provide easy
access to schools, parks and convenience shopping areas.
Schools and parks should be located within the residential
service areas and away from major arteries. There public
facilities should be easily accessible to the people in the
area which they serve without having to cross heavily
traveled arterials. This kind of neighborhood development
should be encouraged in new developments within the planning
area."
Section 2. Subsection H of Urban Development Policy 13 of the
Urbanization Element of the Redmond Urban Area Comprehensive Plan,
found on page 52 of the Plan, is amended to read as follows:
"H. Encouragement of [interesting] alternatives to the
typical grid pattern layout when topography, previous
development or other physical barriers prohibit the grid
pattern."
Section 3. The discussion in paragraph A regarding Collectors in
the Transportation Element of the Redmond Urban Area Comprehensive Plan
found on page 60 of the Plan is amended to read as follows:
"Collectors
A. The function of collectors shall be to:
(a) Be the main traffic artery within a given "neighborhood."
(b) Provide a high degree of land access and maintain low
speeds.
(c) Provide traffic movement between arterials and local
streets.
[(d) Discourage through movement between 'higher order
streets' for traffic not making stops in the neighborhood."]
([e]d) Provide on -street parking."
Section 4. The discussion in paragraph A of the discussion of
Local Streets in the Transportation Element of the Redmond Urban Area
Comprehensive Plan found on Page 61 of the Plan is amended to read as
follows:
"Local Streets
A. A local street's functional purpose shall be to:
(a) Serve short trip desire, small "neighborhood" areas and
small average daily traffic counts.

(b) Provide low levels of mobility and speed, direct access
to individual properties.
(c) Highly discourage through movement except to other local
or collector streets.
[(d) Discourage direct connections to arterial streets.]
Section 5. The Transportation Element of the Redmond Urban Area
Comprehensive Plan is amended to amend Transportation Policy No. 23,
found on Page 64 of the Plan to read as follows:
"23. Local street patterns and residential areas should be
varied from grid patterns [and interesting] wherever
topography, previous development or other physical barriers
prohibit the grid pattern [possible]."
Section 6. The Transportation Element of the Redmond Urban Area
Comprehensive Plan is amended to delete Transportation Policy No. 26,
found on Page 65 of the Plan (regarding loop streets and cul-de-sacs)
and to renumber successive Transportation Policies accordingly.
Section 7. The Transportation Element of the Redmond Urban Area
Comprehensive Plan is amended to add 4 new policies at the end of the
policies section, as follows:
"Circulation within a neighborhood means a direct route of
travel from a residence within the neighborhood to a
destination within the neighborhood, such as a store or park,
when a comparably direct route on a higher order street is
not possible.
The primary function of many local residential streets is to
provide access to residences abutting the street, not to
provide through movement. Their planning and design should
proceed accordingly.
Residential streets should be protected from through traffic;
vehicles traveling on these streets should have a trip origin
or destination in the area served by them. Residential
streets should be protected from vehicles moving at excessive
speeds and parking unrelated to residential activities.
Streets should provide through circulation when not precluded
by environmental or topographic constraints, existing
development patterns or strict adherence to other standards
in this document."
Section 8. Additions and Deletions. Deleted language is set
forth between brackets; new language is set forth in bold-faced type.

Section 9. Severability. The provisions of this ordinance are
severable. If any section, sentence, clause or phrase of this
ordinance is adjudged to be invalid by a court of competent
jurisdiction, that decision shall not affect the validity of the
remaining portions of this ordinance.
Section 10. Codification. County Legal Counsel shall have the
authority to format the provisions contained herein in a manner that
will integrate them into the County Code consistent with the Deschutes
County Form and Style Manual for Board Documents. Such codification
shall include the authority to make such changes, to make changes in
numbering systems and to make such numbering changes consistent with
interrelated code sections. In addition, as part of codification of
these ordinances, County Legal Counsel may insert appropriate
legislative history reference. Any legislative history references
included herein are not adopted as part of the substance of this
ordinance, but are included for administrative convenience and as a
reference. They may be changed to correct errors and to conform to
proper style without action of the Board of County Commissioners.
Section 11. Repeal of Ordinances as Affecting Existing
Liabilities. The repeal, express or implied, of any ordinance,
ordinance provision, or code section by this ordinance shall not
release or extinguish any duty, condition, penalty, forfeiture, or
liability incurred under such ordinance, unless a provision of this
ordinance shall so expressly provide, and such ordinance repealed shall
be treated as still remaining in force for the purpose of sustaining
any proper action or prosecution for the enforcement of such duty,
condition, penalty, forfeiture, or liability, and for the purpose of
authorizing the prosecution, conviction and punishment of the person or
persons who violated the repealed ordinance.
Section 12. Emergency. This ordinance being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this ordinance takes effect on its
passage.
