ORDER NO. 95-148 "i 8-1729
WHEREAS, the road improvements undertaken pursuant to Resolution
No. 94-094 in the Squaw Creek Canyon Recreational Estates Local
Improvement District (Squaw Creek L.I.D.) have been completed and
have been inspected by the County Engineer (Engineer); and
WHEREAS, the County Engineer has recommended to the Board of
County Commissioners of Deschutes County Oregon (Board) that the
roads in the Squaw Creek L.I.D. be accepted as constructed; and
WHEREAS, the Engineer has calculated the actual costs of the
improvements and has determined a proposed final assessment for each
parcel of land for the improvement of roads in the Squaw Creek L.I.D.
and has forwarded a report to the Board recommending that such
amounts be assessed against benefitted properties within the
boundaries of the Squaw Creek L.I.D; and
WHEREAS, Chapter 12.48.240 of the Deschutes County Code provides
that the Board must set a public hearing by Order of the Board to
hear objections to any such final assessment; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. The improvement has been made, inspected by the
Engineer and is hereby accepted by the Board of County Commissioners.
Section 2. That the Engineer's report calculating the actual
costs of the improvements and determining a proposed final
assessment, attached hereto and marked Exhibit "A" is accepted and
hereby approved.
Section 3. That a public hearing to hear objections to the
proposed final assessment shall be held on Wednesday, January 17,
1996, at 10:00 a.m. in the Juvenile Justice Building, 1128 NW
Harriman, Bend, Oregon 97701.
Section 4. That the Director of Public Works, on behalf of the
Board of County Commissioners, shall mail written notice not less
than ten days prior to the date of said hearing to the owners of
record of the parcels described in Exhibit 5 to Exhibit "A" attached
hereto identifying the parcel, showing the proposed final assessment,
and giving notice of the hearing scheduled in Section 2 of this der.

Final Assessment Report
This report is made pursuant to Sections 12.48.220 and 12.48.240 of the Deschutes
County Code (DCC) concerning the compilation of actual costs and determination of the
final assessment for the local improvement.
Background:
On August 17, 1994 the Board of County Commissioners (Board) resolved, by
Resolution No. 94-094, to improve by contract certain dedicated public roads known as
Buffalo Drive, Mountain View Road (from Vista Ridge Drive to its intersection with
Buffalo Drive), Appaloosa Drive, Palamino Drive, Cayuse Drive, Sorrel Drive, Pinto
Drive, Longhorn Drive and Mustang Drive, all as shown on Exhibit 2 to the Engineer's
Report (dated May 9, 1994) and incorporated herein by this reference (hereinafter
referred to as "the improvements"), to Deschutes County local road standards in
conformance with the scope of work as set forth in said Engineer's Report, incorporated
herein by this reference.
Construction Contract:
Engineering plans and construction contract documents for the improvements were
prepared by the Public Works Department. Bids for the project were opened on March
23, 1995. Bids were received from five construction firms: R.L. Coats, $710,284.00;
Bend Aggregate and Paving, $779,593.75; Pieratt Brothers, Inc., $787,084.00; JAL
Construction $842,895.95; and Elting, Inc. $894,978.80. The Board awarded the contract
on March 29, 1995, to the low bidder, R.L. Coats, in the amount of $710,284.00.
Acceptance of Improvements:
The construction of the improvements was completed by the contractor, and inspected
and approved by the Engineer. The final payment on the contract was made on August
25, 1995.
The Engineer recommends Board acceptance of the improvements within Squaw Creek
Canyon Recreational Estates LID. Included in this package for the Board's signature is

Order No. 95-147 for the acceptance and establishment of Buffalo Drive, Mountain View
Road (from Vista Ridge Drive to its intersection with Buffalo Drive), Appaloosa Drive,
Palamino Drive Cayuse Drive, Sorrel Drive, Pinto Drive, Longhorn Drive and Mustang
Drive as County Roads.
Local Improvement - Actual Costs:
The actual costs of the improvement, as defined in DCC 12.48.041, are as follows: the
construction cost is $659,302.94, the engineering and administration cost is $44,208.83,
and financing costs are $15,039.03, for a total improvement cost of $718,550.80. The
actual total improvement cost of $718,550.80 is 22% below the originally estimated total
improvement cost of $922,000. Attached as part of this report are exhibits 1 through 4,
detailing the actual costs.
As noted in exhibit 1, a portion of the construction cost was for improvements to Wilt
road outside the LID boundary. The costs associated with the Wilt Road improvement
were borne by the County and are not part of the assessed costs.
Payment of the construction cost was made from the Local Improvement District Project
Fund (County Fund # 74). This fund will be reimbursed through assessment payments
and a future bond sale. The financing cost included as "actual cost" is the interest cost
associated with the interim financing from the LID Fund (refer to exhibit "3").
Assessment Apportionment:
The method of apportioning the costs of the improvements amongst the benefited
properties shall be as set forth in Resolution No. 94-094. Specifically, the actual costs of
the improvements will be apportioned by dividing the actual costs of the improvements
by the number of lots specially benefiting from the improvements (130), except that the
apportionment's will be adjusted so that the 14 lots abutting Buffalo Drive to the north
will bear an assessment at a rate that is 2/3 of the rate the other specially benefited parcels
bear.
Final Assessment:
Based on the foregoing report, the Engineer recommends that the cost of $718,550.80 be
assessed against the 130 specially benefited lots within Squaw Creek Canyon
Recreational Estates LID at a rate of $5,733.12 per lot for 116 lots and $3,822.08 per
lot for the 14 lots to the north of Buffalo Drive as shown in Exhibit 5. (Note: these
assessments compare to the estimated assessments in Resolution No. 94-094 of $7,356.38
per lot and $4,904.26 per lot respectively).

AMOUNT OF ENGINEER'S PROPOSED ASSESSMENT: <$5,733.12> <$3,822.08>
The Board of County Commissioners has, by Order No. 95-148, set a hearing on Wednesday,
January 17, 1996 „ at the Deschutes County Juvenile Justice Building, 1128 NW Harriman,
Bend, Oregon 97701, at 10:00 a.m., regarding the road improvement affecting the above tax lot
for the purpose of hearing objections to the assessments fixed in the Engineer's Report of the
road improvement abutting your land.
The proposed assessment for this parcel is shown above.
After this hearing, the Board will certify the assessments against each parcel of land by Order
of the Board. When the assessments are certified, you will have thirty (30) days to apply to pay
the assessment in installments. If you do not apply to pay the assessment in installments, the
total amount of the assessment will be due and payable. An application will be mailed after the
assessment is certified.
