An Order Accepting the Road Improvements,
Accepting the Engineer's Assessment Report,
and Setting a Hearing on the Final Assessment
for the Improvements in the Galen Road L.I.D. 0149-0230
ORDER NO. 96-004
WHEREAS, the road improvements undertaken pursuant to Resolution No. 95-065 in the
Galen Road Local Improvement District have been completed and have been inspected by the
County Engineer (Engineer); and
WHEREAS, the Engineer has recommended to the Board of County Commissioners of
Deschutes County Oregon (Board) that the roads in the Galen Road L.I.D. be accepted as
constructed; and
WHEREAS, the Engineer has calculated the actual costs of the improvements and has
determined a proposed final assessment for each parcel of land for the improvement of roads in the
Galen Road L.I.D. and has forwarded a report to the Board recommending that such amounts be
assessed against benefited properties within the boundaries of the Galen Road L.I.D.; and
WHEREAS, Chapter 12.48.240 of the Deschutes County Code provides that the Board
must set a public hearing by Order of the Board to hear objections to any such final assessment;
now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
ORDERS as follows:
Section 1. The improvement has been made, inspected by the Engineer and is hereby
accepted by the Board of County Commissioners.
Section 2. That the Engineer's report calculating the actual costs of the improvements
and determining a proposed final assessment, attached hereto and marked Exhibit "A" is accepted
and hereby approved.
Section 3. That a public hearing to hear objections to the proposed final assessment
shall be held on Wednesday, January 17, 1996, at 10:00 a.m. in the Juvenile Justice Building, 1128
NW Harriman, Bend, Oregon 97701.
Section 4. That the Director of Public Works, on behalf of the Board of County
Commissioners, shall mail written notice not less than ten days prior to the date of said hearing to
the owners of record of the parcels described in Exhibit 5 to Exhibit "A" attached hereto identifying

the parcel, showing the proposed final assessment, and giving notice of the hearing scheduled in
Section 2 of this Order.
Section 5. That the written notice to be given in Section 4 shall comply substantially

RE: Galen Road LID, Final Assessment Report
This report is made pursuant to Sections 12.48.220 and 12.48.240 of the Deschutes
County Code (DCC) concerning the compilation of actual costs and determination of the
final assessment for the local improvement.
Background:
On May 10, 1995 the Board of County Commissioners (Board) resolved, by Resolution
No. 95-065, to improve by contract a certain dedicated public road known as a portion of
Galen Road (hereinafter referred to as "the improvements"), to Deschutes County local
road standards in conformance with the scope of work as set forth in the Engineer's
Report dated April 4, 1995 and accepted by the Board pursuant to Order 95-071,
incorporated herein by this reference.
Construction Contract:
Engineering plans and construction contract documents for the improvements were
prepared by the Public Works Department. The Galen LID construction contract and the
Apache / Lakeview LID construction contract were combined as a single bid. Bids for
the projects were opened on July 27, 1995. Bids were received from six construction
firms: R.L. Coats, $242,100.00; Round Rock Construction, $268,656.68; Hap Taylor
and Sons, $268,834.99; Pieratt Brothers, Inc., $275,896.35; Bend Aggregate and Paving,
$293,523.75; and JAL Construction $363,045.18. The Board awarded the contract on
August 9, 1995, to the low bidder, R.L. Coats, in the amount of $242,100.00 (as noted
above this bid price was for both Galen LID and Apache/Lakeview LID).
Acceptance of Improvements:
The construction of the improvements was completed by the contractor, and inspected
and approved by the Engineer. The final payment on the contract was made on
November 27, 1995.
The Engineer recommends Board acceptance of the improvements within Galen Road
LID. Included in this package for the Board's signature is Order No. 96-005 for the
acceptance and establishment of a portion of Galen Road and Ute Lane as County Roads.

Local Improvement - Actual Costs:

The actual costs of the improvement, as defined in DCC 12.48.041, are as follows: the
construction cost is $66,059.81, the engineering and administration cost is $10,321.91,
and financing costs are $1,219.00, for a total improvement cost of $77,600.72. The actual
total improvement cost of $77,600.72 is 33% below the originally estimated total
improvement cost of $116,150.00. Attached as part of this report are exhibits 1 through
4, detailing the actual costs.
As noted in exhibit 1, a portion of the construction cost was for improvements to Ute
Lane lying outside the LID boundary. The costs associated with the Ute Lane
improvement were borne by the County and are not part of the assessed costs.
Payment of the construction cost was made from the Local Improvement District Project
Fund (County Fund # 74). This fund will be reimbursed through assessment payments
and a future bond sale. The financing cost included as "actual cost" is the interest cost
associated with the interim financing from the LID Fund (refer to exhibit "3").
Assessment Apportionment:
The method of apportioning the cost of the improvements amongst the benefited
properties shall be as set forth in Resolution No. 95-065. Specifically, the actual cost of
the improvements will be apportioned by dividing the actual cost by the number of lots
specially benefiting from the improvements.
Final Assessment:
Based on the foregoing report, the Engineer recommends that the cost of $77,600.72 be
assessed against the 27 specially benefited lots within Galen Road LID at a rate of
$2,874.10 per lot ($77,600.72 / 27)as shown in Exhibit 5. (Note: this assessment
compares to the estimated assessment in Resolution No. 95-065 of $4,316.67 per lot).
