Slaughter, Robert L. Nipper, and Nancy Pope Schlangen. Also in attendance were Bruce White, Assistant County Counsel; Rick Isham, County Counsel; and Brian Harrington, Planner. CONVENE AS THE GOVERNING BODY OF DESCHUTES COUNTY 9-1-1 SERVICE DISTRICT 1. REVIEW OF 9 -1 -1 -COUNTY SERVICE DISTRICT EXPENDITURES Before the Governing Body of 9-1-1 County Service District was review of the weekly expenditures in the amount of $45,919.01. VOTE: SCHLANGEN: YES SLAUGHTER: YES NIPPER: YES CONVENE AS THE DESCHUTES COUNTY BOARD OF COMMISSIONERS CONSENT AGENDA: Consent agenda items before the Board of County Commissioners were: (1) signature of Local Agency Agreement Enhancement Program Project for Ferguson Road; (2) signature of Supplemental Agreement No. 1 Between Oregon Department of Transportation and Deschutes County regarding Fall River Drive Bridge; (3) signature of Personal Services Contract for Elliott and Marlene Morrison; (4) signature of Indemnity Agreement for American Red Cross Wood Program at Knott Landfill; (5) signature of Resolution No. 95-138, appropriating new grant funds for the Health Department; (6) approval of a Business Loan to Tesseract Group, a software company; (7) signature of Personal Services Contract with Peter Dobert for La Pine Community Action Team; (8) signature of Standard Conservation Agreement for LM -95-166; (9) signature of Final Plat for Phase III -B in Broken Top; and (10) signature of Order No. 95-160, declaring the intent and ordering the sale of real property by private sale. VOTE: SCHLANGEN: YES SLAUGHTER: YES NIPPER: YES PUBLIC HEARING ON KNAPP PARTITION REMAND Before the Board was a public hearing on the Knapp Partition Remand. Bruce White stated this was a three lot partition of a 30 -acre parcel for Jim Knapp. This public hearing was being held pursuant to a final opinion and order of remand from the Land MINUTES 2 NOVEMBER 1, 1995 6. 0149-0282 Use Board of Appeals in Case No. 95-046. The LUBA order was dated September 26, 1995. Bruce stated the purpose of this hearing was very narrow and was to advise the parties to the Board partition decision of what has occurred after the appeal. This public hearing will give the parties an opportunity to comment on whether the decision that the Board was proposing to enter today was consistent with LUBA's remand order. Bruce stated there had been no comments submitted. Bruce White recommended signature of the partition decision by the Board. Notice of the decision would be sent out to the parties and would become final twenty-one days after mailing. Chair Slaughter opened the public hearing. Liz Fancher, attorney for the applicant, Jim Knapp, thanked all the parties for getting this long drawn out land use issues resolved. She asked that the Board enter the decision as agreed previously and as directed by LUBA. There being no further testimony, Chair Slaughter closed the public hearing. Bruce White stated that notice was sent to those who were parties to this decision previously. The parties were notified of the date, place and time, as well as the scope of the hearing. SCHLANGEN: I move approval of the revised entered as written decision to approve the partition of the 30 -acre parcel to three 10 -acre parcels pursuant to the opinion and order of remand from the Land Use Board of Appeals in LUBA Case No. 95-046, dated September 27, 1995. NIPPER: I move approval subject to review. SCHLANGEN: Second. VOTE: SCHLANGEN: YES SLAUGHTER: YES NIPPER: YES UPDATE ON SENATE BILL 1145 Before the Board was an update on Senate Bill 1145 by Lt. Greg Brown. Lt. Greg Brown reported the voter passed Measure 11 which requires juveniles that are 15 years or older to be locked up in the adult facility and requires longer sentences for certain adults. The State calculations say there will be 1,764 new inmates generated by Measure 11 over the next couple of years. The County staff believes that number to be low. Every county that Lt. Brown has met with believes the State numbers are inaccurate. Greg stated that as Deschutes County's growth continues to explode, there will be more arrests and there will be more inmates. He stated that Senate Bill 1145 did not take that into consideration. Senate Bill 1145 did two things for Deschutes County. It set up a construction pot of money. The Legislature has allocated approximately $5 million per year to be used to purchase certificates of participation. They believe that $59 million will be generated from that $5 million pot. They will then take the $59 million and allow counties to do construction to provide for the increased number of inmates.
