1996-04813-Order No. 96-006 Recorded 2/1/1996BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Declaring an Intent and Authorizing the Sale of Real Property by Private Sale. ORDER NO. 96-006 WHEREAS, Section 10, Chapter 791, Oregon Laws 1989, authorizes Deschutes County to sell real property in a commercially reasonable manner when the real property is acquired through judicial forfeiture; and WHEREAS, Deschutes County acquired an ownership interest through Judgement of Forfeiture in certain real property described in Exhibit "A;" and WHEREAS, Deschutes County does not need the real property described in Exhibit "A," and has offered said property for sale in a commercially reasonable manner; and WHEREAS, John P. Hargis and Mary Lee Hargis have offered to purchase from Deschutes County the real property described by Exhibit "A" for $138,000.00; and WHEREAS, the offer of John P. Hargis and Mary Lee Hargis is the best offer received by Deschutes County; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the real property described in Exhibit "A" be sold under Section 10, Chapter 791, Oregon Laws 1989, to John P. Hargis and Mary Lee Hargis for $138,000.00. Section 2. That forfeiture counsel be directed to prepare documents and take those actions reasonably calculated to close the sale of the real property described in Exhibit "A." That pursuant to Section 10, Chapter 791, Oregon Laws 1989, Forfeiture Counsel shall deposit the proceeds to the General Fund of Deschutes County for public safety, law enforcement related purposes or criminal justice services, less costs. NIPPER, ommissioner PAGE 2 OF 2 - ORDER NO. 96-006 (1/3/96) EXHIBIT "A" The North 440 feet of the South 880 feet of that portion of the Northeast Quarter of the Southeast Quarter (NEI/a SEI/a) of Section Eleven (11), Township fifteen (15) South, Range Twelve (12) East of the Willamette Meridian, Deschutes County, Oregon, lying Easterly of the Deschutes River. EXCEPTING THEREFROM that portion of lying East of the centerline of N.W. 67th Street, formerly Franks road, a county road, as the same is now located over and across said premises. ALSO EXCEPTING THEREFROM the South 220 feet of the North 440 feet of the South 880 feet of that portion of the NEI/a SEI/a of said Section 11, lying Easterly of the Deschutes River.
