Rights of Way within and adjacent to Hill Crest
Subdivision, located in Deschutes County, Oregon.
ORDER NO. 96-038
WHEREAS, the Board of County Commissioners of Deschutes County, Oregon adopted
Resolution Number 95-069 which declared its intent to Order the vacation of Public Road Rights of
Way within Hill Crest Subdivision in three (3) phases, upon signature of the appropriate plat for each
of the three (3) phases of The Summit Subdivision; and
WHEREAS, the Board of County Commissioners has approved signature of the final plat of
The Summit - Phase One; and now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. That the property, described in Exhibit "A", is hereby vacated.
Section 2. That the Deschutes County Surveyor is directed to mark the plat, where
necessary, as provided in ORS 271.230.
Section 3. That this Order shall be recorded with the Deschutes County Clerk, and copies
shall be filed with the Deschutes County Surveyor and County Assessor.
Section 4. That the property vacated in Section 1 herein shall vest as follows:
The vacated property lying within the boundary of The Summit - Phase One Subdivision shall
vest in the owner(s) of lots platted by The Summit - Phase One Subdivision, which contain
portions of the former right-of-way within their boundaries.
The vacated property lying outside the boundary of The Summit - Phase One Subdivision
shall vest in the owners of lots, platted by The Summit - Phase One Subdivision that abut the
former right-of-way by extension of the platted lot lines.

VACATION OF PORTIONS OF PUBLIC ROAD
RIGHTS OF WAY WITHIN AND ADJACENT TO HILL CREST
SUBDIVISION
All of those portions of public road rights of way shown on the plat of Hill Crest
Subdivision, recorded in the Deschutes County Plat Records lying within the boundary
of The Summit - Phase One Subdivision recorded March 29, 1996 in the Deschutes
County Plat Records, and lying outside of the road rights of way as shown on said plat
of The Summit - Phase One Subdivision.
Also, all of those portions of the alley easement granted to the public by that
easement deed recorded in Volume 155, Page 165, Deschutes County Deed Records,
lying within the boundary of The Summit - Phase One Subdivision recorded March 29,
1996 in the Deschutes County Plat Records, and lying outside of the road rights of way
as shown on said plat of The Summit - Phase One Subdivision.
Also, that portion of road right-of-way, dedicated by Partition Plat Number 1991-
39, recorded July 9, 1991 in the Deschutes County Plat Records, described as follows:
A tract of land located in the Northwest one-quarter of the Southeast one-quarter
of Section 19, Township 15 South, Range 13 East, of the Willamette Meridian,
Deschutes County, Oregon, being more particularly described as follows;
Beginning at a 3/4 inch iron pipe for the southeast one sixteenth corner of said
Section 19; thence along the north south centerline of said Southeast one-quarter North
000 12' 28" West 29.80 feet to the northerly right-of-way of Reservoir Drive and the
TRUE POINT OF BEGINNING; thence continuing along said north -south centerline
North 000 12' 28" West 246.79 feet to a point on the Southerly right-of-way of
September Avenue; thence leaving said north south centerline South 630 42' 28" West
33.40 feet to the east line of Parcel 2, Deschutes County Partition No. 1991-39 (MP -91-
16); thence South 000 12' 28" East along the east line of said Parcel 2, 231.71 feet,
more or less to a point on the Northerly right-of-way of Reservoir Drive; thence South
891 27'22" East 30.00 feet more or less, to the TRUE POINT OF BEGINNING.
