A Resolution Exempting a Contract for Engineering
Services Pertaining to the Planning and Design
of the County's Solid Waste Transfer Stations
from Competitive Bidding Requirements.
RESOLUTION NO. 96-035
WHEREAS, Deschutes County Code chapter 2.36 authorizes and designates the
Board of County Commissioners to serve as the local contract review board; and
WHEREAS, ORS 279.015(3) and Deschutes County Code 4.04.090 authorize the
local contract review board to exempt certain public contracts or classes of public contracts
from competitive bidding requirements under emergency conditions; and
WHEREAS, under OAR 125-310-030, public contracting agencies have discretion
to let public contracts without formal competitive bidding where the price of the contract
does not exceed $25,000 and where emergency circumstances create a substantial risk of
loss, damage, interrupton of services or threat to public health or safety; and
WHEREAS, a recent injury at the County's Fryrear transfer station raises the
possibility that unsafe conditions may exist at the County's solid waste transfer stations; and
WHEREAS, URS Consultants Inc. has previously performed design work pertaining
to the County's solid waste system, is familiar with existing facility designs within that
system, and has significant experience and skill in transfer station design safety; now,
therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That emergency conditions exist that require prompt execution of a
contract to evaluate the design and operation of the County's solid waste transfer stations.
Section 2. In determining the existence of such emergency conditions, the Board
makes the following findings:
(a) That a recent injury at Fryrear transfer station raises the possibility that unsafe

conditions may exist at the County's solid waste transfer stations which could pose a risk of
loss or damage to County personnel and equipment, as well as a threat to public safety.
(b) That failure to initiate a prompt study to assess the safety of the County's
solid waste transfer stations could necessitate the temporarily closure of the transfer station
system, thereby creating an interruption of an important public service and a potential
threat to public health.
Section 3. That the price for the proposed contract with URS Consultants, Inc. for
engineering services pertaining to the planning and design of the County's solid waste
transfer stations is under $25,000.
Section 4. That said contract with URS Consultants, Inc. is hereby exempted from
competitive bidding requirements pursuant to ORS 279.015(3) and Deschutes County Code
4.04.090.
