WHEREAS, on November 22, 1995, the Board of County Commissioners of Deschrate
County, Oregon (Board), initiated by Resolution 95-129, the improvement of certain dedfcatec� ^w
public roads known as 85th Street, 85th Place, Oriole lane, Quail Lane, 78th Street and'
73rd ,
Street lying within Whispering Pines Estates Subdivision; and
WHEREAS, on March 20, 1996, the Board accepted, by Order Number 96-024, the
Engineer's Report relating to said improvements; and D CIO
WHEREAS, the Board by said Order Number 96-024, set a hearing on said improvements
and authorized the Director of Public Works to give notice of said hearing; and
WHEREAS, notice pursuant to Chapter 12.48.190 of the Deschutes County Code was
mailed to each benefited property owner; and
WHEREAS, a hearing on the proposed improvement was held on April 17, 1996, at the
Deschutes County Juvenile Justice Building, Bend, Oregon, for the purpose of hearing testimony
on said improvements; and
WHEREAS, based on the objections received by the Board of County Commissioners and
testimony presented at said hearing, the Board, exercising its discretion under Deschutes County
Code 12.48.200, has decided not to proceed with said improvements; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDERS as follows:
Section 1. That the local improvement known as 85th Street L.I.D. is hereby declared
abandoned and no new petition may be filed and no new resolution may be adopted for this
improvement within a period of one year after the date of this order.
