An Ordinance Amending Title 18, the
Deschutes County Zoning Ordinance Map
to Correct an Error and Declaring An
Emergency.
ORDINANCE NO. 96-037
Whereas, that portion of parcels 1 and 3 of Partition Plat No.
1990-35 lying within Section 30 of Township 18, Range 12 Willamette
East Meridian and those portions of tax lots 4300 and 4111 lying
outside of an area zoned on the Deschutes County Zoning Ordinance Map
for Surface Mining (referred to hereafter as "subject area") were
erroneously zoned Forest Use 2 (F-2) on the County Zoning Map when the
County updated its Forest Zone zoning maps in 1992; and
Whereas, the subject area previously was zoned Rural Residential
Use - 10 (RR -10) on the County Zoning Map and after the adoption of the
1992 Forest Zone zoning maps should have continued to reflect such
zoning; and
Whereas, it is desireable to amend the Deschutes County Zoning Map
to correct the error; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDAINS as follows:
Section 1. Adoption of Zoning Map Amendment. That Title 18, the
Deschutes County Zoning Map, as amended, is further amended to change
the zoning designation for the subject area as depicted on Exhibit A
attached hereto and by this reference incorporated herein, from its
current Forest Use (F-2) zoning designation to Rural Residential (RR -
10) zoning.
Section 2. Findings. In support of this ordinance, the Board
adopts the findings set forth in the recitals set forth above and the
findings supporting adoption of Ordinances 92-060 and 92-061.
Section 3. Severability. The provisions of this ordinance are
severable. If any section, sentence, clause or phrase of this
ordinance or any line or area on amy map is adjudged to be invalid by
a court of competent jurisdiction, that decision shall not affect the
validity of the remaining portions of this ordinance.
Section 4. Codification. County Legal Counsel shall have the
authority to format the provisions contained herein in a manner that
will integrate them into the County Code consistent with the Deschutes
County Form and Style Manual for Board Documents. Such codification
shall include the authority to make such changes, to make changes in
numbering systems and to make such numbering changes consistent with
interrelated code sections. In addition, as part of codification of
these ordinances, County Legal Counsel may insert appropriate

legislative history reference. Any legislative history references
included herein are not adopted as part of the substance of this
ordinance, but are included for administrative convenience and as a
reference. They may be changed to correct errors and to conform to
proper style without action of the Board of County Commissioners.
Section 5. Emergency. This ordinance being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this ordinance takes effect on its
passage.
