An Ordinance Amending PL -20, the
Deschutes County Comprehensive
Plan Map to Clarify Certain Map
Designations and Declaring An
Emergency.
ORDINANCE
NO. 96-036
Whereas, that portion of parcels 1 and 3 of Partitioat No.
1990-35 lying within Section 30 of Township 18, Range 12 Willamette
East Meridian and those portions of tax lots 4300 and 4111 lying
outside of an area designated on the Comprehensive Plan Map for Surface
Mining (referred to hereafter as "subject area") were erroneously given
overlapping Comprehensive Plan Map designations of Forest Use and Rural
Residential Use when the Comprehensive Plan Map was codified under
mapping adopted by Ordinances 92-060 and 92-061; and
Whereas, the subject area previously was designated for Rural
Residential Use and after the adoption of Ordinances 92-060 and 92-061
should have continued to reflect such Plan designation; and
Whereas, it is desireable to amend the Plan Map to correct the
error; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDAINS as follows:
Section 1. Adoption of Plan Map Amendment. That PL -20, the
Deschutes County Comprehensive Plan Map, as amended, is further amended
to change the plan map designation for the subject area as depicted on
Exhibit A attached hereto and by this reference incorporated herein,
from its current designation to Rural Residential.
Section 2. Findings. In support of this ordinance, the Board
adopts the findings set forth in the recitals set forth above and the
findings supporting adoption of Ordinances 92-060 and 92-061.
Section 3. Severability. The provisions of this ordinance are
severable. If any section, sentence, clause or phrase of this
ordinance or any line or area on amy map is adjudged to be invalid by
a court of competent jurisdiction, that decision shall not affect the
validity of the remaining portions of this ordinance.
Section 4. Codification. County Legal Counsel shall have the
authority to format the provisions contained herein in a manner that
will integrate them into the County Code consistent with the Deschutes
County Form and Style Manual for Board Documents. Such codification
shall include the authority to make such changes, to make changes in
numbering systems and to make such numbering changes consistent with
interrelated code sections. In addition, as part of codification off
these ordinances, County Legal Counsel may insert appropriat

legislative history reference. Any legislative history references
included herein are not adopted as part of the substance of this
ordinance, but are included for administrative convenience and as a
reference. They may be changed to correct errors and to conform to
proper style without action of the Board of County Commissioners.
Section 5. Emergency. This ordinance being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this ordinance takes effect on its
passage.
