6. PUBLIC HEARING ON A PLAN AMENDMENT AND ZONE CHANGE TO AMEND
THE COUNTY COMPREHENSIVE PLAN AND ZONING ON 27 -ACRES FROM RR -
10 TO EFU-TRB, EXCLUSIVE FARM USE TUMALO, REDMOND, BEND
SUBZONE AND ADOPTION OF ORDINANCES NO. 96-030 AND 96-031
Before the Board was a public hearing on a plan amendment and
zone change to amend the County Comprehensive Plan and zoning
on 27 -acres from RR -10 to EFU-TRB, exclusive farm use in
Tumalo, Redmond and Bend Subzones and adoption of Ordinance
No. 96-030 and 96-031.
Paul Blikstad explained that in 1983 this area was rezoned to
EFU but was not put on the maps that way. This was a
correction of a mistake made in 1983.
Chair Schlangen opened the public hearing. There being no
public testimony, Chair Schlangen closed the public hearing.

DECISION ON APPEAL A-96-1, AN APPEAL OF HEARINGS OFFICER'S
DECISION ON A SITE PLAN FOR A CLUBHOUSE AND MAINTENANCE
BUILDING FOR LOST TRACTS GOLF COURSE
Before the Board was a decision on Appeal A-96-1, an appeal of
the Hearings Officer's decision on a site plan for a clubhouse
and maintenance building for Lost Tracts Golf Course.
Bruce White reported there had been two letters received after
the record had been closed. He stated there were a number of
issues discussed at the work session. One was whether the
site plan was consistent with the conditional use, what was
approved by the conditional use and what can the county do by
way of a site plan approval to help define what the use was
that was approved. He stated that site plan reviews were to

deal with design features of a site and conditional use
approval was to deal with the operational impacts and
characteristics of the proposed use. Another issue was
whether the club house fit the definition of an accessory use.
Another issue was what site was involved in the site plan. He
stated the parking lot size was also an issue. Legal
counsel's view point was that the standard sets a minimum size
in the number of parking spaces. He stated the amount of open
space was at issue and whether the club house and parking lot
are part of the open space. He state there also was an issue
regarding deceleration lane.
Further discussion followed regarding the above mentioned
issues.
SLAUGHTER: I move that we overturn the Hearings Officer's
decision and deny the site plan for the
clubhouse and maintenance building for the
Lost Tracts Golf Course.
NIPPER: I'll second that.
Commissioner Nipper felt that the application was incomplete.
It was not inclusive of the requirements such as landscaping
plan, lighting plan, bike parking, etc. He had questions as
to whether the proposed facility went beyond the realm of the
proposed accessory use. He felt there were questions of
whether the entrance and exit. He questioned the Hearings
Officer's ability to modify the information.
Commissioner Schlangen felt the definition of the reduced size
of the club house was okay, the parking lot was appropriate,
but there were other parts of the site plan that were not
complete. She stated she would support the motion that there
was a new site plan needed.

8. ADOPTION OF ORDINANCE NO. 96-013, ADOPTING TITLE 11, COUNTY
OWNED LAND AND PROPERTY, OF THE DESCHUTES COUNTY CODE
Before the Board was adoption of Ordinance No. 96-013,
adopting Title 11, County Owned Land and Property, of the
Deschutes County Code.
Brad Chalfant reported this was an ordinance which would
codify the procedures for regulating use of public land and
includes developed facilities and undeveloped county land.

Rick Isham stated it should be noted that each of the three
municipal jurisdictions within the county have consented to
this ordinance.

SIGNATURE OF RESOLUTION NO. 96-062, AUTHORIZING ISSUANCE OF
LOCAL IMPROVEMENT DISTRICT BONDS
Before the Board was signature of Resolution No. 96-062,
authorizing the issuance of Local Improvement District Bonds.
Bruce White reported this resolution authorizes the county to
issue up to $700,000 in bonds to finance the six different
local improvement projects. The security for the bonds would
be the payments coming in from the assessments as well as the
county's taxing authority up to and including the $10 cap.

REGARDING REGIONAL TRANSPORTATION SYSTEM FOR CENTRAL OREGON

a Grant Application for COIC regarding a Regional
Transportation System for Central Oregon.
Susan Mayea reported this was through the Petroleum Antitrust
Grant Fund. This supports COIC 's grant application to the
grant fund to do the regional planning program in the amount
of $75,000.
