1996-25076-Ordinance No. 96-053 Recorded 7/10/199696-250"76 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES An Ordinance Amending Title 18, the Deschutes County Zoning Ordinance by Changing the Zoning of Certain Property and declaring an Emergency. .REVIEWED i CEL k ORDINANCE NO. 96-053 - WHEREAS, applicants Wilma Salmons et al applied -'.7or a quasi-judicial amendment to the Deschutes County Zoning Map -to' -.change the zone for 9 tracts of land covering 105 acres from EFU`=°TRB to MUA-10; and WHEREAS, the Board of County Commissioners approved the application on the condition that certain improvements be made to Hunnell Road and entered a Resolution of Intent to Restore (Resolution No. 96-085) to that effect; and WHEREAS, the required road improvements have been completed and approved by the County Public Works Department; now therefore THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON ORDAINS as follows: Section 1. That Title 18, the Deschutes County Zone Map, as amended, is further amended to change the zone designation for the subject 105 acres, as more fully described in Exhibit "A" and depicted in Exhibit "B" attached hereto and by this reference incorporated herein, from EFU-TRB to MUA-10. Section 2. In support of its decision, the Board adopts the findings and decision of the County, attached to Ordinance 96-052 and incorporated herein by reference. Section 3. The repeal, express or implied, of any ordinance, ordinance provision, code section, or any map or any line on a map incorporated therein by reference, by this amending ordinance shall not release or extinguish any duty, condition, penalty, forfeiture, or liability previously incurred under such ordinance, unless a provision of the amending ordinance shall so expressly provide, and such ordinance repealed shall be treated as still remaining in force for the purpose of sustaining any proper action or prosecution for the enforcement of such duty, condition, penalty, forfeiture, or liability, and for the purpose of authorizing the prosecution, conviction and punishment of the person or persons who previously violated the repealed ordinance. 1 - ORDINANCE NO. 96-053 "AKPOF'ILMED JUL 1'1' 1996 KEYP � ED ��1L = ? 1 996 Section 4.
