1996-26463-Order No. 96-056 Recorded 7/18/1996��5�°O�s� REv�ElNED ss -26403 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES An Ordinance Amending the Bend Area General Plan to Add Policies Regarding Siting of Destination Resorts, to Adopt a Map of Sites Eligible for Destination Resort Siting and Declaring an Emergency. ORDINANCE NO. CO TY, LM"(WNMLL— ---------------- 96-056 WHEREAS, Deschutes County and the City of Bend have joint planning responsibility for the lands between Bend's Initial Urban Growth Boundary (IUGB) and Urban Growth Boundary (UGB), pursuant to the "Agreement Between the City of Bend, Oregon, and Deschutes County, Oregon, For the Joint Management of the Bend Urban Area"; and WHEREAS, Deschutes County and the City of Bend have determined to implement ORS 197.435 to 197.467 and Statewide Planning Goal 8 regarding the siting of destination resorts; and WHEREAS, in implementing the destination resort statute and Goal 8 it is necessary to adopt policies for the Bend Area General Plan regarding the siting of destination resorts and to adopt a map of lands eligible for the siting of destination resorts; and WHEREAS, public hearings have been held in conformance with state law to implement the destination resort statute and Goal 8 mapping requirement; now therefore, THE BOARD OF COMMISSIONERS OF DESCHUTES COUNTY, OREGON ORDAINS AS FOLLOWS: Section 1. Amendment of Plan Text. The text of the Urban Area Reserve discussion in the Open Lands section of the Bend Area General Plan, as set forth in the second paragraph of that section on Page 17 of the Plan (as paginated in 1979 version), is amended to read as follows, with deleted text lined thEeugh and new text in bold and underlined: "The area also has some potential for destination resorts and recreational development. Oregon's land use laws provide for the mapping of lands that are suitable and appropriate for destination resorts using specific criteria. In 1996, the Urban Area Reserve lands were evaluated using these criteria, and approximately 1,960 acres of Urban Area Reserve lands south and west of "P'HLL ,JILL 2 4 1 i 1 - Ordinance 96-056 i 0094665.01 %155-0389 M Section 2. Amendment of Plan Policies. The text of the Urbanization section of the Bend Area General Plan, as set forth starting on page 12 of the Bend Urban Area General Plan (1979 version) and as subsequently amended, is further amended to add the following new policies: 119. In addition to lands excluded from eligibility for destination resort siting under state law, the following lands within the urban area reserve shall not be mapped as eligible for destination resort siting: a. All lands owned by public agencies. b. All lands zoned for surface mining. C. All lands zoned SR -2J and all lands platted for subdivisions. d. Land for which contiguous area not otherwise removed from eligibility is less than 160 acres, except where adjoining land under the same ownership outside the urban area reserve is mapped with the Deschutes County destination resort (DR) overlay. e. Single parcels, or adjoining parcels in the same or related ownership (including lands outside the urban area reserve), of less than 160 acres. f. Lands not adjacent to either (1) F1 zoning, or (2) Deschutes County destination resort (DR) overlay adjoining F1 zoning. 10. Destination resorts, as defined by state law, shall only be allowed in areas designated for such use on the destination resort map adopted by the County and City of Bend on July 17, 1996 and included as an exhibit in the General Plan. 11. A destination resort within the Urban Area Reserve shall be served by municipal water and sewer service or an approved community water and sewer service for domestic use. 12.
