WHEREAS, the Bend Urban Area General Plan Map has on this date
been amended to change the planning designation on certain property
from Residential, 6,000 square feet minimum land area per dwelling unit
to Light Industrial; and
WHEREAS, the justification for the Plan Amendment requires that
the subject property be zoned with a Light Industrial Zone; and
WHEREAS, The Deschutes County Sheriff's Department applied to
amend the zone map of the Bend urban Area Zoning Ordinance so the
subject property could be zoned Light Industrial; and
WHEREAS, a hearing was held on July 23, 1996, after notice given
in accordance with law, before the County Hearings Officer;
WHEREAS, the Hearings Officer recommended approval of the proposed
zone change;
WHEREAS, the decision of the Hearings Officer has not been
appealed; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTPES COUNTY, OREGON,
ORDAINS, as follows:
Section 1. Adoption of Amendment to Bend Urban Area Zoning Map.
Title 19 of the Deschutes County Code, the Bend Urban Growth Boundary
Zoning Ordinance, as amended, is further amended to change the zone
designation of the property described on the attached Exhibit A, and as
depicted on Exhibit B, attached hereto and by this reference
incorporated herein, from SR2.5, Suburban Low Density Residential, to
IL, Light Industrial.
Section 2. Findings. The Board adopts
findings the Findings and Decision of the County
September 11, 1996, relating to Zone Change
attached as Exhibit C to Ordinance 96-072 hereto
incorporated herein.

Section 3. Severability. The provisions of this ordinance are
severable. If any section, sentence, clause or phrase of the ordinance
or any line or area on any map is adjudged to be invalid by a court of
competent jurisdiction, that decision shall not affected the validity
of the remaining portions of this ordinance.

Section 4. Codification. County Legal Counse s all have the
authority to format the provisions contained herein in a manner that
will integrate them in the County Code consistent with the Deschutes
County Form and Style Manual for Board Documents. Such codification
shall include the authority to make such changes, to make changes in
numbering systems and to make such numbering changes consistent with
interrelated codes sections. In addition, as part of codification of
these ordinances, County Legal Counsel may insert appropriate
legislative history references. Any legislative history references
included herein are not adopted as part of the substance of this
ordinance, but are included for administrative convenience and as a
reference. They may be changed to correct errors and to conform to the
proper style without action of the Board of County Commissioners.
Section 5. Emergency. This Ordinance being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this Ordinance takes effect on its
passage.

(17), Township Seventeen (17) South, Range Twelve (12) East of the Willamette Meridian,
Deschutes County, Oregon, described more particularly as follows:
Beginning at the center 1/4 corner of Section Seventeen (17), Township Seventeen (17), South,
Range Twelve (12) East of the Willamette Meridian, thence North 89053'48" West 1351.27 feet;
