RESOLUTION NO. 96-152
WHEREAS, the Board of County Commissioners may set a fee fob tie
filing of petitions for local improvements in accordance with Deschutes
County Code Section 12.48.140 reflecting the actual cost incurred by
the County in reviewing the petition, completing the feasibility study,
providing notice of abandonment, organizing neighborhood meetings and
conducting mail polls; and
WHEREAS, the actual cost estimated to be incurred by the County
for the activities set forth in Deschutes County Code Subsection
12.48.140(A) is $3,290.50 as set forth in Exhibit A to this Resolution;
now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. That the filing fee for petitions for local
improvements, pursuant to Deschutes County Code Section 12.48.140, is
$800.

Per the newly adopted Local Improvement District Ordinance, the Board may by
resolution or order adopt filing fees and deposit requirements for petitions for local
improvements. The filing fee shall reflect the actual cost incurred by the County in
reviewing the petition, completing the feasibility study, providing notice of abandonment,
organizing neighborhood meetings and conducting a mail poll pursuant to the LID code.
Attached is an estimate of the actual cost incurred by the County in processing a typical
LID petition. The average cost estimate is $3,209.50.
In order to place a fee on the LID petition that is not prohibitive to the formation of
LID's, the Department recommends that the Board set the fee at no more than $600. The
filing fee is non-refundable, however, it will constitute a credit against the final
assessment(s) for the parcel(s) of land owned by the person(s) who paid the fee.
For LID's that are approved and constructed, the county's costs above the fee will be
recovered as a part of the total project cost. The county's cost incurred in processing
LID's that fail to gain approval will be absorbed by the LID project fund (Fund 74),
which has adequate working capital to cover these costs.
