1996-46510-Order No. 96-123 Recorded 12/19/199696-46510 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Providing for the Exchange of Real Property and Personal Property with Anne E. Hanson and Making `: the Required Findings. ORDER NO. 96 -123 -- WHEREAS, ORS 275.100 provides that Deschutes County may exchange real property and personal property with private persons when it deems such exchange to be in the best interest of Deschutes County; and WHEREAS, the Board of County Commissioners of Deschutes County did adopt Resolution No. 96-140 providing for a hearing for the exchange of real property and personal property between Deschutes County and Anne E. Hanson; and WHEREAS, said hearing was held on December 18,1996; and WHEREAS, the Board of County Commissioners finds that the exchange of the real property herein described is in the best interest of Deschutes County; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, AUTHORIZES AND ORDERS as follows: Section 1. The real property to be transferred by Anne E. Hanson is described as follows: Parcel 1 A parcel of land containing 3,966 square feet (0.091 Acres), more or less, located in a portion of Section 17, Township 17 South, Range 12 East, Willamette Meridian, Deschutes County, Oregon, being more particularly described as follows: Beginning at a point which bears North 44°03'48" West a distance of 1878.35 feet from a 2" brass cap marking the southeast corner of said Section 17; thence around a 1050.00 foot radius curve left 107.35 feet (chord bears North 01'51'31" West, 107.30 feet); thence North 04°47'15" West a distance of 217.58 feet; thence North 65°55'52" East a distance of 30.59 feet; thence South 01° 04'14" PAGE 1 OF 3 - ORDER NO. 96-123 (12/18/96) -;c:irilAEC; KPU HED 0t'i: 1 1996 F.1 0156--0718 West a distance of 336.60 feet to the "Point of Beginning," the terminus of this description. Parcel 2 A parcel of land containing 900 square feet, more or less, located in a portion of the North One -Half (N1/a) of Section 17, Township 17 South, Range 12 East, Willamette Meridian, Deschutes County, Oregon, being more particularly described as follows: Beginning at a 1/z" iron rod on the easterly boundary line of Lot 19, Glen Vista which bears North 31'54'01" West a distance of 2488.36 feet from a 2" brass cap marking the southeast corner of said Section 17; thence around a 1050.00 foot radius curve right 10.34 feet (chord bears South 00°49'27" West, 10.34 feet); thence South 89°53'09" West a distance of 24.95 feet; thence North 01'06'23" West a distance of 36.00 feet to a point on the southerly right of way line of Hardy Road; thence along said southerly right of way line North 89°53'09" East a distance of 25.00 feet to a 1/2" iron rod marking the northeast corner of said Lot 19, Glen Vista; thence along the easterly boundary line of said Lot 19 South 01'06'23" East a distance of 25.66 feet to the "Point of Beginning", the terminus of this description. The personal property to be transferred by Deschutes County is described as follows: The residential structure currently located at 20309 Hardy Road, Bend, Oregon, described as a 1,498 square foot wood frame residence that is constructed to include a 6 -room floor plan including three bedrooms and two and one-half baths. Anne E. Hanson would be responsible for removing said structure from its current site and relocated said structure to another site. That upon review and approval of title by Deschutes County Legal Counsel the exchange of real property and personal property as referenced is hereby authorized. Section 3. Under the Public Facilities section of the County Comprehensive Plan, on page 97, General Policies is the following: 5. Deschutes County shall encourage the formation of special service districts to serve rural needs rather than becoming involved with serving those needs.. The County will foster coordination and mutual planning between the County, special districts, utility companies and service corporations. This shall include trenching where appropriate. It is clear from the Comprehensive Plan that these service districts, such as the proposed annexation to the fire district, are necessary and appropriate. Wildfire hazard is also recognized by the Plan as a major concern in rural areas. The annexation into a fire district will help alleviate wildfire concerns. Quality Services Performed with Pride
