1997-00873-Resolution No. 97-002 Recorded 1/9/199797-00873 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES A Resolution Providing for the Calling of a Three -Year Serial Levy Election in Deschutes County, Oregon, on March 11, 1997, for the Purpose of Submitting to the Qualified Voters of Deschutes County, Oregon, the Question of Authorizing a Three -Year Serial Levy of $9,400,000 Each Year for Three Years for Sheriff Operating Purposes Outside Limitation of Taxation Set Forth in Article XI, Section 11, Oregon Constitution Using a Split Levy; and Providing a Ballot Title. REVIEWED COUNTY OREGON * CD RESOLUTION NO. 97-002 WHEREAS, the Board of County Commissioners of Deschutes County, Oregon has determined that a three-year serial levy should be submitted to the qualified voters of the County outside the tax base as established by Article XI, Section 11, Oregon Constitution, in order to permit the proper operation of Deschutes County Sheriff's Department; and WHEREAS, the Board makes findings, in accordance with Chapter 4.32, Deschutes County Code, set forth in Exhibit A, attached hereto and by this reference incorporated herein, in support of a split levy with $4,452,000 levied each year for three years within the incorporated cities, Black Butte Ranch Service District and Sunriver, and $4,948,000 be levied each year for three years in the remaining unincorporated Deschutes County, Oregon; and WHEREAS, it is necessary to submit the question of authorizing a three-year serial levy to the legal voters of Deschutes County, Oregon; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. Date of Election. The measure set forth in Section 2 of this Resolution shall be submitted in the manner prescribed herein to the qualified voters of Deschutes County, Oregon, at a special election to be held March 11, 1997. At the serial levy election, there shall be submitted to the legal voters of Deschutes County, Oregon, for their approval or rejection, the following measure: CAPTION: SHERIFF THREE-YEAR OPERATING SPLIT SERIAL LEVY. QUESTION: Shall Deschutes County levy $9,400,000 split levy each year for three years beginning 1997/98 outside tax base for Sheriff services? SUMMARY: Current Sheriff's serial levy ends on June 30, 1997. Renewed levy increases jail capacity from 150 to 180 inmates. Juvenile hold capacity increases to 65. Nine new patrol deputies will be added over three years. Split levy provides patrols in rural areas. Sheriff split serial levy will levy $4,452,000 each year for three years within incorporated cities, Black Butte Ranch Service District and Sunriver. These areas fund local patrol services. $4,948,000 each year for three years will be levied in remaining areas of Deschutes County. Difference in levy amounts is the cost of rural Sheriff patrols. Funds school anti-drug program. Funds truck safety inspections, emergency services, animal control, drug enforcement and community policing. Continues arson investigation team. Total amount raised by three-year serial levy for Sheriff operations is $28,200,000. This amount of proposed taxes are outside limitation imposed by Section 11, Article XI, Oregon Constitution. Sheriff will continue to receive funds from general fund. The revenues raised will be used exclusively for other governmental purposes. Section 3. Findings. In accordance with Deschutes County Code Chapter 4.32, the Board hereby adopts the Findings of Fact set forth in Exhibit A, attached hereto and by this reference incorporated herein. Section 4. Deschutes County Sheriff patrol services are not provided within incorporated cities, Black Butte Ranch Service District and Sunriver because these areas are patrolled by local agency patrols utilizing non -county sworn police officers paid by the local agency. The level and types of services provided outside these areas is significantly different because the remainder of Deschutes County is served with peace officer patrol services provided by the Deschutes County Sheriff. The overall cost of providing sheriff services within incorporated cities, Black Butte Ranch Service District and Sunriver is substantially less than the cost of providing services in the remainder of unincorporated Deschutes County, Oregon. The areas where there is a difference are easily identified because the areas receiving patrol services from non -county peace officers are within the limits of Bend, Redmond and Sisters, the boundary of the Black Butte Ranch Service District and Sunriver as defined in Chapter 4.32, Deschutes County Code. Only in the remainder of the county are sheriff patrols routinely provided. If sheriff patrol officers respond within incorporated cities, Black Butte Ranch Service District or Sunriver, the response is in accordance to a request for service, and PAGE 1 - EXHIBIT A TO RESOLUTION NO. 97-002 (1-9-97) in the role as back-up, as mutual aid, or when specialized expertise is required. The sheriff patrol response within incorporated cities, Black Butte Ranch Service District and Sunriver is similar to the mutual response arrangements for fire and ambulance services from separate districts. The difference in cost of providing services within the incorporated cities, Black Butte Ranch Service District and Sunriver and the remaining rural areas is $1,450,000 per year based upon the Sheriff's budget. The total cost of the Sheriff's budget less the rural area patrols is $7,950,000. This amount apportioned among the total county value equals a 56 percent to 44 percent split. This results in a distribution of rural patrol costs plus 44 percent of the remaining department budget to the area of Deschutes County outside the incorporated cities, Black Butte Ranch Service District and Sunriver. This amount, when applied to the levy of $9,400,000 results in a levy of $4,948,000 for the portion of the county outside the incorporated cities, Black Butte Ranch Service District and Sunriver and a levy of $4,452,000 within those areas.
