ORDER NO. 97-006 WHEREAS, the Deschutes County Board of Commissioners initiated the formation of a LaPine Water District on September 18, 1996, by passing Order No. 96-072; and WHEREAS, a public hearing was held on October 23, 1996, to consider the formation and any objections thereto and to determine whether the affected area would be benefitted by the formation of a water district; and WHEREAS, after consideration of economic, demographic, and sociological trends and projections pertinent to the proposal, past and prospective physical developments of the land that would directly or indirectly be affected by the proposal, and all other matters considered to be relevant to the formation, the Board is of the opinion that the area would be benefitted by the formation of a water district; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the formation of the LaPine Water District be approved. Section 2. That the boundaries of the territory to be included in the district are as set forth in the legal description and as depicted in the map attached hereto as Exhibits 1 and 2, respectively. Section 3. That the applicable land use criteria pertinent to the proposed district, the facts found by the Board, and the reasons why the Board believes those facts to bring the proposal within the requirements of the applicable land use criteria are described in Exhibit 3, attached hereto and, by this reference, incorporated herein. Section 4. That a final hearing on the matter of formation be held on February 3, 1997, at 10 a.m. in Room A of the Juvenile Justice Center. 1 - ORDER NO. 97-006 KlyP 0156-1216 Section 5. An election on formation will be held if written requests for an election are filed at or before the hearing by not less than 15 percent of the electors or 100 electors, whichever is the lesser number, registered in the proposed district. If the required number of written requests for an election are not received by the Deschutes County Board of Commissioners' Office before or at the hearing, the Board will enter a final order creating the district at the final hearing. Under the public facility and service policies section for the La Pine Urban Unincorporated Community is the following: 36. The County shall support the development, re -development and expansion of a single domestic water system so that cumulative development will not result in public health problems or adverse environmental impacts that violate state or federal water quality regulations.
