and Anita Mutchie, Recording Secretary. -�
Bruce White reported the outside of the record contacts;iad=been
put into the record. He stated there was no decision un4i fF was
reduced to writing. c)
Bruce White reviewed the applicable criteria with the Board of
Commissioners. He also reviewed the vote the Board had made on
each one of the criteria on a the previous occasion.

Commissioner Slaughter stated he had a problem, as he did not feel
that this created a hardship for the applicant. He stated the
Board new this was deer winter range and they should maintain it as
that. He felt he erred when he made his previous decision.
Commissioner Nipper felt the Community Development Department had
given wrong information to the Cosgraves. Commissioner Nipper felt
that all four of the criteria had been met.
Commissioner Slaughter felt they had the right to build one house.
SLAUGHTER: I move we uphold the Planning Commission's
decision.
Bruce White stated the Planning Commission decided the first
criteria they could not interpret so they decided not to take a
position on it. On the second criteria, they said that it had not
been met because the way they interpreted it was that the

difficulty was from the zoning, and that it was not unique to this
site was throughout the area.
Commissioner Schlangen stated that she went along with that even
though the first time she did not vote that way.
SCHLANGEN: I would second Barry's motion to adopt the
decision of the Planning Commission.
VOTE: SCHLANGEN: YES
SLAUGHTER: YES
NIPPER: NO
