An Order Providing for Deschutes
County to Make an Exchange of
Contingent Future Interests With
the Ray Johnson Post #44, American
Legion, Department of Oregon, and
the City of Redmond and Making the
Required Findings.

WHEREAS, ORS 275.100 provides that Deschutes County may exchange real property
and personal property with private persons when it deems such exchange to be in the best
interest of Deschutes County; and
WHEREAS, the Board of County Commissioners of Deschutes County did adopt
Resolution No. 97-012 providing for a hearing to authorize a three-way exchange of
contingent future interests with the Ray Johnson Post #44, American Legion, Department of
Oregon hereafter known as the American Legion and the City of Redmond, a municipal
corporation; and
WHEREAS, said hearing was held on March 12,1997; and
WHEREAS, the Board of County Commissioners finds that the foregoing exchange
of interests in real property is of equivalent value; and
WHEREAS, the Board of County Commissioners finds that the exchange of interest
in the real property herein described is in the best interest of Deschutes County; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, AUTHORIZES AND ORDERS as follows:
Section 1. That Deschutes County shall be authorized to transfer to the American
Legion a reversionary interest it holds on property situated in the City of Redmond, Deschutes
County, State of Oregon, generally known as the Ray Johnson Post #44, American Legion
Hall and generally described as:
The North half (Nl/z) of Lot Ten (10), and all of Lots Eleven (11) and Twelve
(12) in Block Sixty-seven (67) of the original townsite of the City of Redmond,

according to the official plat thereof now on file in the office of the County
Clerk, of Deschutes County, Oregon.
As consideration for said transfer, the American Legion shall transfer to the City of Redmond
a reversionary interest it holds on the real property situated in the City of Redmond, Deschutes
County, State of Oregon, generally known as Ray Johnson Park and generally described as:
Blocks Five (5), Six (6), Seventeen (17) and Eighteen (18) of Redmond
Townsite Company's Second Addition to the City of Redmond, according to the
official map and plat thereon filed in the office of the County Clerk of
Deschutes County, Oregon.
As consideration to Deschutes County for said transfer, the City of Redmond shall transfer to
Deschutes County a reversionary interest in real property situated in Deschutes County,
Oregon, which the City of Redmond will acquire as a replacement site for Ray Johnson Park.
Said replacement site is to be acquired with the funds generated from the sale of the original
Ray Johnson Park.
Section 2. That upon review and approval of title by Deschutes County Legal Counsel
the exchange of interest in real property as referenced is hereby authorized.
Section 3. The Deschutes County Property and Real Estate Manager is authorized to
take those actions reasonably calculated to fulfill the referenced exchange.
