BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON
An Order Providing for Deschutes I ` ` t7 ,M 6
County to Exchange Real Property
with the Deschutes National Forest,
U.S. Department of Agriculture,
and Making the Required Findings.
ORDER NO. 97-028
WHEREAS, ORS 275.100 provides that Deschutes County may exchange real property
with another governmental body when it deems such exchange to be in the best interest of
Deschutes County; and
WHEREAS, the Board of County Commissioners of Deschutes County did adopt
Resolution No. 96-141 providing for a hearing for the exchange of real property between
Deschutes County and the Deschutes National Forest, U.S. Department of Agriculture; and
WHEREAS, said hearing was held on January 8, 1997 and continued on January 29,
1997; and
WHEREAS, the Board of County Commissioners finds that the Deschutes National
Forest is an agency of the United States government; and
WHEREAS, the Board of County Commissioners finds that the interest's in real
property generally described in Exhibits "A" and "B," attached hereto and incorporated
herein, are determined to be of equal value; and
WHEREAS, the Board of County Commissioners finds that the exchange of the real
property herein described is in the best interest of Deschutes County; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, AUTHORIZES AND ORDERS as follows:
Section 1. That Deschutes County shall be authorized to transfer real property to the
Deschutes National Forest, U.S. Department of Agriculture which is generally described in
Exhibit "A," in exchange for real property to be transferred by the Deschutes National Forest,
U.S. Department of Agriculture as generally described in Exhibit "B."
Section 2. That as a condition of closing said exchange, the general terms of a
management plan be developed as well as a Conservation Easement protecting and restricting
development on at least that portion of Exhibit "B" containing the rare plant, Pecks'

Penstemon. Said Conservation Easement shall be recorded concurrently with the closing of
this exchange.
Section 3. That upon review and approval of title by Deschutes County Legal Counsel
the exchange of real property as referenced is hereby authorized.
Section 4. The Deschutes County Property & Real Estate Manager is authorized to
take those actions reasonably calculated to fulfill the referenced exchange.

The real property to be transferred by Deschutes County is generally described as follows:
Parcel 1
The Northwest Quarter (NWI/a), the North One-half of the Southwest Quarter
(Nl/2SWI/a) and the Southwest Quarter of the Southwest Quarter (SWI/4SWI/4)
of Section Thirty-six (36), Township Fifteen (15) South, Range Ten (10), East
of the Willamette Meridian, Deschutes County, Oregon.
Parcel 2
A Tract of land in the Southeast Quarter (SEI/a) of Section Twenty-six (26),
Township Twenty (20) South, Range Ten (10), East of the Willamette Meridian,
Deschutes County, Oregon, described as follows:
Beginning at the South I/4 corner of said Section 26, thence North 0°40'17" East
along the West line of the Southwest Quarter of the Southeast Quarter
(SWI/aSEI/a) of said Section 26 to the Northwest corner thereof; thence North
89°07'00" East along the North line of the SWI/aSEI/4 of said Section 26, 324.70
feet; thence South 0°20'14"West, 343.67 feet; thence North 89°07'00" East,
1,331.18 feet to the East line of the West Half of the West Half of the Southeast
Quarter of the Southeast Quarter (WI/2Wl/2SEI/aSEI/a), of said Section 26;
thence South 0°20'14"West along the East line of the WI/2Wl/2SEI/aSEI/4 of said
Section 26, 980.28 feet to the South line of said Section 26; thence South

Oregon, lying Northeasterly of the McKenzie Highway.
