This levy keeps current budgeted Sheriff positions. This levy is main funding for Sheriff patrols, Jail, Emergency Services, Search & Rescue, drug and arson enforcement. Estimated tax rate is 71 cents per thousand dollars real market value within incorporated cities, Black Butte Ranch Service District and Sunriver. Estimated tax rate is 96 cents per thousand dollars real market value in rest of Deschutes County. This one-year split levy will levy $3,146,400 within incorporated cities, Black Butte Ranch Service District and Sunriver because these areas fund local patrol services. $3,753,600 will be levied for one year in rest of Deschutes County. Total amount raised for Sheriff operations is $6,900,000. This amount of proposed taxes is outside limitation imposed by section 11, Article X1, Oregon Constitution, but is subject to the limits of section l lb, Article XI, Oregon Constitution. This levy will be an additional tax under section 11 g, Article XI, Oregon Constitution. The category of this levy is other governmental purposes to be used exclusively for Sheriff operations. The estimated tax cost for this measure is an ESTIMATE ONLY based on the best information available from the county assessor at the time of the estimate. Section 3. Findings. In accordance with Deschutes County Code Chapter 4.32, the Board hereby adopts the Findings of Fact set forth in :Exhibit B attached hereto and by this reference incorporated herein. Section 4. Notice. The County Clerk shall give notice of the election as provided in the general election laws. Section 5. Filing. S GEN, Commissioner Chapter 432 SPLIT SERIAL LEVIES Sections: 432.010 Definitions. 432.020 Geographic tax classification. 432.030 Required findings. 432.010 Definitions. A. "Black Butte Ranch Service District" means the area encompassed by Black Butte Ranch Service District, a municipal corporation formed under the laws of the State of Oregon. B. "Incorporated cities" means the area encompassed by the cities of Bend, Redmond, Sisters and any other city incorporated pursuant to Oregon Revised Statutes chapter 221. C. "Sunriver" means that portion of unincorporated Deschutes County, Oregon identified in the Deschutes County Comprehensive Land Use Plan as the planned community of Sunriver and zoned Planned Community (PC) Zone lying northerly and westerly of south Century Drive. For the purposes of this chapter, Sunriver does not include that portion of the PC Zone designated IndustrialI District, commonly known as the Sunriver Business Park. The board, may upon making the findings required by section 432.030 of this chapter, refer a measure to the electors which provides a different tag burden on one class of taxpayers than is imposed upon another lass of taxpayers. Any difference in tag burden imposed within separate geographic boundaries within Deschutes County, Oregon shall meet the Chapter 432 PACE I -EXHIBIT A TO RESOLUTION 97-040 513-2411 following criteria: A. Differences in services to be provided in different geographic areas must be real and substantial. B. Geographic boundaries shall be drawn so that services provided within designated areas are qualitatively different from services provided within other geographical areas. C. Services provided within the different geographical areas must be unique. D. Any differences in tax burdens shall be based upon the actual costs of providing services. (Ord. 94-009 § 1, 1994) (5/95) 0156-2411EXHIBIT B to Resolution 97-040 FINDINGS OF FACT Sheriff patrol services are not provided uniformly within Deschutes County, Oregon. Deschutes County Sheriff patrol services are not provided within incorporated cities, Black Butte Ranch Service District and Sunriver because these areas are patrolled by local police agency patrols utilizing non -county sworn police officers paid by the local agency. The level and types of services provided outside these areas is significantly different because the remainder of Deschutes County is served with peace officer patrol services provided by the Deschutes County Sheriff. The overall cost of providing sheriff services within incorporated cities, Black Butte Ranch Service District and Sunriver is substantially less than the cost of providing services in the remainder of unincorporated Deschutes County, Oregon. The areas where there is a difference are easily identified because the areas receiving patrol services from non -county peace officers are within the limits of Bend, Redmond and Sisters, the boundary of the Black Butte Ranch Service District and Sunriver as defined in Chapter 4.32 of the Deschutes County Code. Only in the remainder of the county are sheriff patrols routinely provided. If sheriff patrol officers respond within incorporated cities, Black Butte Ranch Service District or Sunriver, the response is in accordance to a request for service, and in the roll as back- up, as mutual aid, or when specialized expertise is required. The sheriff patrol response within. incorporated cities, Black Butte Ranch Service District and Sunriver is similar to the mutual response arrangements for fire and ambulance services from separate districts. The difference is cost of providing services within the incorporated cities, Black Butte Ranch Service District and Sunriver and the remaining rural areas is $1,200,000 per year based upon the Sheriffs budget. The remaining $5,700,000 of the levy is apportioned among the total county value equals a 55.2 percent to 44.8 percent split. This amount, when applied to the levy of $6,900,000 results in a levy of $3,753,600 for the portion of the county outside the incorporated cities, Black Butte Ranch Service District and Sunriver, and a levy of $3,146,400 within those areas. The existing levy expires on June 30, 1997. The proposed levy is again a split -rate levy. This means taxpayers in the cities of Bend, Redmond, Sisters, and taxpayers in Sunriver and Black Butte will pay a lesser rate because those areas have locally -funded police patrols. The proposed one-year levy only keeps the current authorized positions and maintains the adult jail at the same number of beds (150) as the previous year. Monies raised will not be used for the new juvenile jail being constructed. Without a renewed levy, over one-half of the sheriff employees will be laid -off. Eighty percent (80%) of the sheriff employees are either deputies providing law enforcement or correction employees providing adult jail lockup. The sheriff provides law enforcement in the unincorporated areas of the county where over one- half the county population resides. Calls for service have increased from 27,000 in 1994 to over 47,000 in 1996. In 1997, over 53,000 calls for service are expected. Deschutes County remains the fastest population growing county in the state. The sheriff is the only law enforcement agency that must provide public safety services countywide. "These services include operation of the only adult jail in the county, court security and court process, search and rescue, and emergency services. Some sheriff operations are funded by contracts and are not included in the levy. These services include motor carrier enforcement, marine boating safety, patrols for the forest service and others.
