ORDER NO. 97-045 WHEREAS, a petition requesting withdrawal of territory from the Sisters -Camp Sherman Rural Fire Protection District and annexation of said territory into the Cloverdale Rural Fire Protection District was duly filed with the Board of County Commissioners of Deschutes County, Oregon; and WHEREAS, a public hearing was held on the petition on March 26, 1997, to hear the petition and to determine whether, in accordance with the Comprehensive Plan, applicable Land Conservation and Development Goals and the criteria prescribed by ORS 199.462 and 198.805, the affected area would be benefited by transferring the said territory from the Sisters -Camp Sherman RFPD to the Cloverdale RFPD; and WHEREAS, after consideration of economic, demographic and sociological trends and projections pertinent to the proposal, past and prospective physical developments of the land that would directly or indirectly be affected by the proposal, and all other matters considered to be relevant to the petition, the Board is of the opinion that the area would be benefited by the transferring of the said territory from the Sisters -Camp Sherman RFPD to the Cloverdale RFPD and that the requirements of ORS 198.870(4)are satisfied; and WHEREAS, there are no electors in the territory and owners of 100% of the land have signed the petition and consequently there is no need for a second hearing for the purpose of allowing for objections of electors to this withdrawal and annexation; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That the petition for withdrawal from the Sisters -Camp Sherman Rural Fire Protection District and annexation into the Cloverdale Rural Fire Protection District be and hereby is approved. Section 2. That the boundaries of the subject territory are as set forth in Exhibit 1 and as depicted on the map marked Exhibit 2, both of which are attached hereto and by this reference incorporated herein. That the applicable land use criteria pertinent to the proposed boundary changes, the facts found by the Board and the reasons why the Board believes those facts to bring the proposal within the requirements of the applicable land use criteria are described in Exhibit 3, attached hereto and by this reference incorporated herein. Section 4. The purpose of the Cloverdale Rural Fire Protection District is to provide fire protection services within said District. DATED this 26th day of March, 1997. Under the Public Facilities section of the County Comprehensive Plan, on page 97, General Policies is the following: 5. Deschutes County shall encourage the formation of special service districts to serve rural needs rather than becoming involved with serving those needs. The County will foster coordination and mutual planning between the County, special districts, utility companies and service corporations. This shall include trenching where appropriate. It is clear from the Comprehensive Plan that these service districts, such as the proposed annexation to the fire district, are necessary and appropriate. Wildfire hazard is also recognized by the Plan as a major concern in rural areas. The annexation into a fire district will help alleviate wildfire concerns. This request to withdraw from the territory of the Sisters - Camp Sherman RFPD and annex to the Cloverdale RFPD still provides for the necessary fire protection for the subject property.
