A Resolution Declaring an Intent
to Sell Real Property by Private Sale.
RESOLUTION NO. 97-049
WHEREAS, ORS 275.225 authorizes Deschutes County to sell surplus County land by
private sale when the assessed value is less than $5,000.00 and the property is unsuited for the
construction or placement of structures thereon under current zoning ordinances and building
codes of Deschutes County; and
WHEREAS, Deschutes County owns certain real property generally described in
Exhibit "A," which is not needed by Deschutes County; and
WHEREAS, the real property described in Exhibit "A" is unsuited for construction
under current zoning regulations and has an assessed value of $1,040.00; and
WHEREAS, Robert H. Bennett has requested that Deschutes County sell the real
property described by Exhibit "A" for the assessed value of $1,200.00, along with any
transaction costs chargeable; now therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, RESOLVES as follows:
Section 1. That the legal notice described in Exhibit "B," shall be published in the
"Bulletin" on April 16, 1997.
Section 2. That the Board of County Commissioners shall accept written comment on
the proposed private sale through April 30, 1997, whereafter the Board may act to sell the real
property described in Exhibit "A" to Robert H. Bennett, by way of a bargain and sale deed.

A parcel of land beginning on the South line of the East Half of the Northwest Quarter of
Section 17, in Township 16 South, Range 12, E.W.M., in Deschutes County, Oregon, at a point
660.00 feet West of the Southeast corner of the Northwest Quarter of said section; thence
North 00°48' East 200.00 feet; thence East parallel with the South line of said Northwest
Quarter 340.00 feet to the center of the Tumalo Water Ditch; thence Southwesterly along the
center of said ditch to a point on the South line of said Northwest Quarter; thence West 240.00
feet to the place of beginning.

PUBLIC NOTICE
The Board of County Commissioners of Deschutes County, Oregon hereby announce
its intent to sell at private sale, pursuant to ORS 275.225, that real property generally described
as follows:
A parcel of land beginning on the South line of the East Half of the Northwest
Quarter of Section 17, in Township 16 South, Range 12, E.W.M., in Deschutes
County, Oregon, at a point 660.00 feet West of the Southeast corner of the
Northwest Quarter of said section; thence North 00°48' East 200.00 feet; thence
East parallel with the South line of said Northwest Quarter 340.00 feet to the
center of the Tumalo Water Ditch; thence Southwesterly along the center of
said ditch to a point on the South line of said Northwest Quarter; thence West
240.00 feet to the place of beginning.
SUBJECT TO: All easements, restrictions and rights-of-way of record and those
common and apparent on the land.
The assessed value of the real property herein described is $1,040.00. The private sale
as described in the Board of County Commissioners's Resolution No. 97-049, shall be
authorized not sooner than fifteen (15) days following publication of this notice. Written
objections or other comment on the proposed private sale shall be accepted through April 30,
1997 and should be directed to Deschutes County Property Management, 1340 NW Wall
Street, Bend, Oregon 97701. Upon consideration of said written comments, the Board may
act to sell the real property as described to Robert H. Bennett, by way of a bargain and sale
deed.
