An Order Approving and Confirming
the Sale of Certain Real Property
Acquired by Deschutes County.
ORDER NO. 97-081
WHEREAS, Deschutes County has acquired title to certain real property pursuant to
a variety of means, including real property tax foreclosure proceedings on file in the Circuit
Court of the State of Oregon for Deschutes County; and
WHEREAS, the Deschutes County Board of Commissioners did adopt Order No. 97-
042 on March 26, 1997, and Order No. 97-060 on April 9, 1997, ordering the Deschutes County
Sheriff to offer for sale the real property described in Exhibit "A," attached hereto and by this
reference incorporated herein; and
WHEREAS, the Deschutes County Sheriff did offer for sale that real property
described in Exhibit "A" on May 1, 1997, in the Bend Armory of the Oregon National Guard
at 875 S.W. Simpson Avenue, Bend, Oregon, and thereafter conditionally accepted written bids
submitted through May 7, 1997, pursuant to Orders No. 97-042 and 97-060; and
WHEREAS, the Deschutes County Sheriff has received bids equal to, or in excess of
the minimum bids set forth in Orders No. 97-042 and 97-060, and the highest bid for each
property being herein set forth in the Sheriffs Return, attached hereto as Exhibit "B," and by
this reference incorporated herein; and
WHEREAS, it appears that the bids set forth in Exhibit "B" are the highest and best bid
received at sale, said bids being equal to or exceeding the minimum bid set forth in Orders No.
97-042 and 97-060, and it is in the best interest of the County to accept said bids; and
WHEREAS, notice was given to all municipal corporations within Deschutes County
pursuant to ORS 275.170 as described in Exhibit "C," attached hereto and by this reference
incorporated herein, and said municipal corporations having failed to respond within 20 days,
any such assessment liens claimed pursuant to ORS 275.130 are waived; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. That the bids set forth in Exhibit "B" are hereby approved and confirmed.

Section 2. The Deschutes County Office of Property Management is directed to
prepare bargain and sale deeds for all properties sold and that promissory notes and trust
deeds be prepared for those properties sold on terms as described in Exhibit "B," to be signed
by the Board of County Commissioners.
Section 3. That the Deschutes County Treasurer is directed to pay any and all Local
Improvement District liens on those real properties shown as sold and listed in Exhibit 'B,"
along with any costs associated with the forgoing sale from the proceeds listed in Exhibit 'B."
Section 4. That the Sheriffs sale authorized by Orders No. 97-042 and 97-060 is hereby
confirmed and closed.
Section 5. That the Deschutes County Property and Real Estate Manager is authorized
to take those actions reasonably calculated to fulfill this Order.

to bidding. With respect to properties having a minimum bid equal to or in excess of $8,000,
or in the event that the successful bid is $8,000 or above, said property may be purchased with
cash or financed 20% down, balance at 9% interest over 10 years, in equal monthly payments.
Payment of the bid price or down -payment may be made by personal check if drawn upon an
account located within Deschutes County, otherwise payment shall be made by cashiers check
to the Sheriffs deputy conducting the sale, at the time that the high bid is determined. A check
guarantee card will be required for any payment by personal check. Returned or dishonored
checks will be prosecuted to the full extent of the law.
This auction shall be continuous from and after the above sale date until closed by the
Board of County Commissioners. Written offers to purchase any parcel not sold on May 1,
1997, shall be received by me in my offices through the following Wednesday, May 7, 1997, at
4:00 p.m. and shall be opened at 4:15 p.m. that day in the office of Property Management, 1340
NW Wall Street, Bend, Oregon. The highest offer for any parcel which is equal to or exceeds
the minimum bid price shall be conditionally accepted. In the event two or more offers are
equal, the offer received first shall be conditionally accepted. Upon acceptance of such offer,
the sale as to that parcel shall be deemed closed. Written offers must be accompanied by a
cashier's check payable to Deschutes County and must include the complete name and mailing
address of the bidder. Offers may be made through a licensed real estate agent. The County
shall pay a five percent (5%) real estate commission to licensed real estate agents who appear
at the sale on behalf of a client whose bid is accepted by the Board of County Commissioners.
Commissions shall not be paid to realtors representing themselves or any entity in which they
have a financial interest. Realtors who wish to appear at the auction on behalf of a client and
therein be eligible for a real estate commission shall register on April 24 and 25, 1997, at the
Property Management Office, 1340 N.W. Wall Street, Bend, Oregon and provide a photocopy
of their current real estate license to County personnel. Commissions will not be paid unless
the realtor pre -registers and provides the required documentation at the time of registration.
All parcels are sold as is. Potential bidders should thoroughly investigate all aspects of a
property prior to bidding. Deschutes County has not surveyed the aforementioned real

properties and makes no representation as to boundaries, encroachments or encumbrances.
Deschutes County does not guarantee or warrant that any parcel is buildable, suitable for
septic system, has legal access, is vacant or is usable for any particular purpose. The County
shall not warrant or defend the fee simple title of real property offered for sale to be free of
defects or encumbrances, but will only sell and convey such interest as the County acquired
by foreclosure or other means and holds at the time of sale.
Conveyance is subject to all valid, recorded easements, road right of way dedications and
the right of any municipal corporation to purchase such property pursuant to State law and
subject to the right of the Board of County Commissioners to reject any and all bids. Example
copies of County land sale contract documents are available for review at the office of
Deschutes County Property Manager, Deschutes Services Building, 1340 N.W. Wall, Bend,
Oregon 97701. Packets of tax lot maps may be purchased from the Deschutes County
Property Management at the above address.
