Amendments: The provisions of Chapter 2.54,require amendments to implement the Deschutes County Corrections Supervisory Authority Board as previously adopted by the Deschutes County Board of Commissioners on March 5, 1997. The amendments, as set forth in Exhibit "A", attached hereto and by this reference incorporated herein, are hereby adopted with new language set forth as underlined type and deleted language in strikeout. Section 2. Severability. The provisions of this ordinance are severable. If any section, sentence, clause or phrase of this ordinance is adjudged to be invalid by a court of competent jurisdiction, that decision shall not affect the validity of the remaining portions of this ordinance. Section 3. Codification. County Legal Counsel shall have the authority to format the provisions contained herein in a manner that will integrate them into the County Code consistent with the Deschutes County Form and Style Manual for Board Documents. Such codification shall include the authority to make such changes, to make changes in numbering systems and to make such numbering changes consistent with interrelated code sections. In addition, as part of codification of these ordinances, County Legal Counsel may insert appropriate legislative history reference. Any legislative history references included herein are not adopted as part of the substance of this ordinance, but are included for administrative convenience and as a reference. They may be changed to correct errors and to conform to proper style without action of the Board of County Commissioners. Section 4. Emergency. This ordinance being necessary for the immediate preservation of the peace, health and safety, an emergency is declared to exist, and this ordinance takes effect on its passage. Compensation; expense reimbursement. 2.54.050. Meetings, attendance and quorum. 2.54.060. Powers and duties. 2.54.070. Conflicts of interest. 2.54.080. Appeal. 2.54.090. Discretionary authority. 2.54.010. Board name. The name of the board shall be the Deschutes County Corrections Supervisory Authority Board, hereinafter referred to as "the board." (Ord. 97- 009 § 1, 1997) 2.54.020. Purpose. The purpose of the board is to operate corrections supervision services and custodial facilities within Deschutes County pursuant to ORS 144.087. (Ord. 97-009 § 1, 1997) 2.54.030. Board membership. A. The membership of the board shall consist of: 1. one county commissioner; 2. the county sheriff, 3. the county administrator; 4. the director of community justice for Deschutes County and 5. three electors of Deschutes County to be appointed by the Sheriff. B. The chair of the board shall be the Sheriff of Deschutes County. C. The Deschutes County Corrections Director for the Sheriffs Department and the Department Manager for Adult Parole and Probation shall provide administrative support to the board, but shall not be members of the board. (Ord. 97-044 § 1, 1997; Ord. 97-009 § 1, 1997) 2.54.040. Compensation; expense reimbursement. No board member shall receive compensation, but shall be reimbursed for authorized expenses. (Ord. 97-009 § 1, 1997) 1 - EXHIBIT A to Ordinance 97-044 (6-4-97) 0162-013'7 2.54.050. Meetings, attendance and quorum. A. The board shall hold at least one regular meeting each month at a time and place fixed by it. B. A majority of the board shall constitute a quorum. C. The meetings of the board will be on the third Tuesday of every month where the third Tuesday is a legal business day. The board shall comply with all appropriate provisions of the Public Meetings Act as set forth in ORS Chapter 192 as amended from time to time by the Oregon Legislature. (Ord. 97-044 § 1, 1997; Ord. 97-009 § 1, 1997) 2.54.060. Powers and duties. A. The board shall be responsible for inmate sanctions and supervision, and policies and procedures for correction supervision services and custodial facilities within Deschutes County. B. All terms of imprisonment or incarceration of 12 months or less ordered by Deschutes County Courts must be served at the direction of the board, except as provided in ORS 137.124, 137.593(2)(d) and 423.478. (Ord. 97- 009 § 1, 1997) 2.54.070. Conflicts of interest. A member of the board shall not participate in any board proceeding or action in which any of the following have a direct, substantial financial interest: the member or his spouse, brother, sister, child, parent, father-in-law, mother-in-law, or any business with which he is negotiating for or has an arrangement or understanding concerning prospective investment or employment. Any actual or potential interest shall be disclosed at the meeting of the board where the matter is being considered. (Ord. 97-009 § 1, 1997) 2.54.080. Appeal. The decision of the board shall be the final decision of the county. (Ord. 97-009 § 1, 1997) 2.54.090. Discretionarvauthori All decisions of the Deschutes County Corrections Supervisory Authority Board are discretionary. Chapter 2.54 is intended to carry out the provisions and intent of the Oregon 0162-0138 Legislature as adopted in Senate Bill 1145, Chapter 423, Oregon Laws (1995). The implementation of SB 1145 by the Deschutes County Board of Commissioners, under Ordinance No. 97-009 and this ordinance, is to provide the greatest scope of delegation and discretion to the Deschutes County Corrections SupervisoryAuthorityBoard to meet the needs of the community and to join with the State of Oregon to implement the partnership as outlined by SB 1145.
