An Ordinance Adopting Deschutes County Code /f�
Chapter 2.60, Intergovernmental Entities, Pursuant
to ORS 190.085; Ratifying the Creation of the
Accountable Behavioral Health Alliance; and
Declaring an Emergency.
ORDINANCE NO. 97-039
WHEREAS, ORS 190.085 requires local governments to enact ordinances ratifying the creation of
intergovernmental entities through intergovernmental agreements prior to the effective date of the agreement; and
WHEREAS, the Counties of Deschutes, Benton, Jefferson and Lincoln wish to bid on the contract for
Oregon Health Plan services on which the State is currently taking proposals; and
WHEREAS, the Counties have agreed that a proposal submitted by the four counties combined into one
intergovernmental entity would have a greater chance of success than proposals submitted by the Counties
individually; and
WHEREAS, the Counties have agreed that, as an intergovernmental entity, they will be able to provide the
best possible behavioral health services to the client population of all four Counties; and
WHEREAS, the intergovernmental entity shall have the power to enter into contracts, provide mental health
services under the Oregon Health Plan as a unified entity, provide other behavioral health services as a unified entity,
and provide all administrative services necessary for the provision of these services;
WHEREAS, it is the intent of the Board of County Commissioners of Deschutes County, Oregon, to create
an intergovernmental entity by intergovernmental agreement; and
WHEREAS, the intergovernmental agreement shall be effective no later than June 23, 1997; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as
follows:
Section 1. Adoption. Deschutes County Code Chapter 2.60, Intergovernmental Entities, as set forth in
Exhibit A attached hereto and by this reference incorporated herein, is hereby adopted.
Section 2. Summary. Pursuant to ORS 190.085, enacted in 1991, each of the parties to an
intergovernmental agreement creating an intergovernmental entity is required to enact an ordinance ratifying the
creation of the intergovernmental entity. Deschutes County wishes to participate in a four -county intergovernmental
entity to be known as the Accountable Behavioral Health Alliance, which shall submit a proposal on, and, if
successful, offer, behavioral health services in the client base of the four -county region represented.
Section 3. Repeal. The Deschutes County Board of County Commissioners has the authority to repeal
this Ordinance with 90 days written notice to Benton, Lincoln and Jefferson Counties.
Section 4. Severability. The provisions of this ordinance are severable. If any section, sentence, clause
or phrase of this ordinance is adjudged to be invalid by a court of competent jurisdiction, that decision shall not affect
the validity of the remaining portions of this ordinance.

Section 4. Severability. The provisions of this ordinance are severable. If any section, sentence,
clause or phrase of this ordinance is adjudged to be invalid by a court of competent jurisdiction, that decision shall
not affect the validity of the remaining portions of this ordinance.
Section 5. Codification County Legal Counsel shall have the authority to format the provisions
contained herein in a manner that will integrate them into the County Code consistent with the Deschutes County
Form and Style Manual for Board Documents. Such codification shall include the authority to make such changes,
to make changes in numbering systems and to make such numbering changes consistent with interrelated code
sections. In addition, as part of codification of these ordinances, County Legal Counsel may insert appropriate
legislative history reference. Any legislative history references included herein are not adopted as part of the
substance of this ordinance, but are included for administrative convenience and as a reference. They may be
changed to correct errors and to conform to proper style without action of the Board of County Commissioners.
Section 6. Emergency. This Ordinance being necessary for the immediate preservation of the public
peace, health, and safety, an emergency is declared to exist, and this Ordinance take effect on its passage.

2.60.030 Accountable Behavioral

2.60.010. Purpose.
The purpose of this chapter is to ratify
the creation of intergovernmental entities through
intergovernmental agreements pursuant to ORS
190.085 (Ord. 97-039 § 1, 1997)
2.60.020. Definition -Intergovernmental
entity.
For purposes of this chapter,
"intergovernmental entity" shall mean an entity
created through an intergovernmental agreement
pursuant to ORS Chapter 190 governed by a
board or commission appointed by, responsible
to, and acting on behalf of the parties to the
intergovernmental agreement. (Ord. 97-039 § 1,

2.60.020. Accountable Behavioral
Health Alliance.
Deschutes County ratifies the creation of
the Accountable Behavioral Health Alliance
(Alliance).
The Alliance shall have the power to
enter into contracts, provide mental health
services under the Oregon Health Plan, provide
behavioral health services as a unified entity, and
provide all administrative services necessary for
the provision of these services. (Ord. 97-039 § 1,
