ORDINANCE NO. 97-042 WHEREAS, Ordinance No. 85-029 adopted the Sisters Transportation Element providing transportation background information, goals, findings and policies for the Sisters Urban Area; and WHEREAS, PMR Dev. Co., L.L.C. applied for an amendment to the Sisters Urban Area Comprehensive Plan to revise the transpoOrtation element to reflect and support requested map amendments outlined in Ordinance No. 97-043; and WHEREAS, the Deschutes County Planning Commission after review conducted in accordance with applicable law, has recommended approval of the proposed Amendments to the Sisters Urban Area Comprehensive Plan (Ordinance No. 85-029); and WHEREAS, after notice was given and hearing conducted in accordance with applicable law, the Board of County Commissioners has considered the Planning Commission recommendation; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. Amendment of Transportation Element. The Transportation Element of the Sisters Urban Area Comprehensive Plan is amended to repeal Road Systems Policy 1 of the 1985 Transportation Element of the Sisters Urban Area Comprehensive Plan set out on page 5 of Ordinance 85- 029, as shown on Exhibit A, attached hereto and by this reference incorporated herein. Section 2. Amendment of Transportation Element. The Transportation Element of the Sisters Urban Area Comprehensive Plan is amended to add a new Road Systems Policy 1 which reads as follows: " 1. The County and City shall support the development of Hood Avenue, between Highway 20 and Highway 242, to allow local traffic to bypass the intersection of Highway 20 and Highway 242. The County and City shall also support the development of Hood Avenue to collector street standards to provide an additional east -west route for Sisters area traffic to access downtown Sisters and to access the state highway system at the east and west ends of downtown Sisters." ; ,cC i' A, D 1W KEYP HEG J `k 97 JUN ` 1997 PAGE 1 - ORDINANCE NO. 96-042 (June 25, 1997) 01 62=0498 Section 3. Findings. Findings supporting the adoption of the proposed amendments are set forth in the Staff Report - File No. PA -97-3, attached hereto as Exhibit B and by this reference incorporated herein. Section 4. Severability. The provisions of this ordinance are severable. If any section, sentence, clause or phrase of this ordinance is adjudged to be invalid by a court of competent jurisdiction, that decision shall not affect the validity of the remaining portions of this ordinance. Section 5. Codification. County Legal Counsel shall have the authority to format the provisions contained herein in a manner that will integrate them into the County Code consistent with the Deschutes County Form and Style Manual for Board Documents. Such codification shall include the authority to make such changes, to make changes in numbering systems and to make such numbering changes consistent with interrelated code sections. In addition, as part of codification of these ordinances, County Legal Counsel may insert appropriate legislative history reference. Any legislative history references included herein are not adopted as part of the substance of this ordinance, but are included for administrative convenience and as a reference. They may be changed to correct errors and to conform to proper style without action of the Board of County Commissioners. Section 4. Repeal of Ordinances as Affecting Existing Liabilities. The repeal, express or implied, of any ordinance, ordinance provision, code section, or any map or any line on a map incorporated therein by reference, by this amending ordinance shall not release or extinguish any duty, condition, penalty, forfeiture, or liability previously incurred or that may hereafter be incurred under such ordinance, unless a provision of this amending ordinance shall so expressly provide, and such ordinance repealed shall be treated as still remaining in force for the purpose of sustaining any proper action or prosecution for the enforcement of such duty, condition, penalty, forfeiture, or liability, and for the purpose of authorizing the prosecution, conviction and punishment of the person or persons who previously violated the repealed ordinance. This ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this ordinance takes effect on its passage. On -street parking along Cascade Street results in major conflicts between local cross traffic and through traffic. 9. A one-way traffic couplet is one possible solution to reduce traffic congestion along Cascade Street. 10. Side streets having 80 foot rights-of-way provide good potential parking areas for the CG, General Commercial and RH, High Density Residential zoning districts. 11. The Oregon State Highway Department maintains Cascade Street between the curbs. The City of sisters is responsible for Cascade Street from the curb to the right-of-way line. 12. The City of Sisters does not have an adequate maintenance . program for repair of streets and sidewalks. 13. The City does not have a storm drain system to dispose of snowmelt ponding and storm run-off. 14. Most existing arterial, collector, and local streets do not meet current adopted urban road standards. 15. Cascade Street is not capable of accomodating the projected traffic for the planning period without major modification. 16. Public transit services are not available for the Sisters Urban Area other than through inter -city bus lines. 17. A few bicycle paths or pedestrian lanes exist in the Sisters Urban Area. 18. Sisters Eagle Air Inc. provides a runway for local business and recreational purposes. 19. Commercial air service is provided at Roberts Field in Redmond. 20. Financing to meet transportation needs is a critical problem. In addition, the amendment request includes amending the text of the SUACP to reflect and support this amendment. LOCATION• The subject property consists of lots identified on Deschutes County Assessor's map as 15-10-08 tax lots 700, 701, 702, 703, 704, 705, 706, 708 and a portion of 707. REVIEWER: Heidi Kennedy, Assistant Planner STANDARDS AND APPLICABLE CRITERIA: Title 21 of the County Code, Sisters Urban Area Zoning Ordinance: Chapter 21.20, General Commercial District - CG. Chapter 21.52, Airport Overlay Zone - OA. PL -16, the Sisters Urban Area Comprehensive Plan establishes an overall planning and development framework for the Sisters urban area. Title 22 of the Deschutes County Code, Dechutes County Development Procedures Ordinance. OAR 660-12, the Oregon Transportation Planning Rule. BASIC FINDINGS: 1. LOCATION: -he subject property is located within the Sisters urban area. The property is bordered by Highway 242 on the north and by Pine Street on the east. The small portion of Parcel 3 of MP -80-103 that will be dedicated for development as Washington Avenue is planned as Urban High Density Residential (RH) land and is presently zoned RH. 3. PROPERTY DESCRIPTION: The subject property consists of Parcels 1 and 2 of MP -80-103, the undedicated right-of-way of Hood Avenue that lies between Pine Street and Highway 242 and a small portion of Parcel 3 of MP -80-103, which will serve as the right-of-way for Washington Avenue. The subject property is 15.15 acres in size and is generally level. The property has been cleared and is being used as pasture land. There is an existing farm -related storage building located just south of the subject property, adjacent to Pine Street, on Parcel 3 of MP -80-103. According to the submitted burden of proof, the building is located on the portion of the property that will be dedicated for the proposed extension_ of Washington Street. 4. SURROUNDING LAND USE: The land to the south of the subject property is currently vacant. This area is currently designated RH and RS by the Sisters urban area comprehensive plan. The RH and RS planned property was recently rezoned from UAR-10 to RH and RS by Deschutes County. (See County Files# PA-95-15/ZC-95-12) Land directly to the east and north of the subject property is zoned CG, General Commercial. This area is and a gasoline station and developed with two motels convenience store. The land to the north across Highway 242 is land owned by the United States Forest Service (USFS) and is zoned LM, Landscape Management. Property to the west of the subject property is developed as the Patterson llama and elk ranch. The northern portion of the Patterson property that adjoins Highway 242 lies within the Sisters urban growth boundary and is zoned LM, Landscape Management. The remainder of the Patterson property is zoned EFU-SC. Property to the east of the subject property is zoned CG, General Commercial and RH, Residential - Urban High Density. This area has been developed with commercial buildings and a professional office building. 1. Additionally, the US Forest Service has developed and approved a plan to develop USFS property as a visitor's area with an informational kiosk, trails and a rest area. According to the submitted burden of proof, the USFS has agreed to allow PMR Dev Co LLC to construct Hood Avenue between the iotation where the and US Highway road enters the USFS kiosk parking 242. This intersection occurs at an acute angle which is believed, by traffic experts, including ODOT, to pose traffic safety problems. In order to create a ninety degree angle intersection for Hood Avenue and Highway 242 and to align Hood Avenue with the portion of Hood Avenue that will be constructed on the USFS kiosk property, the applicant has requested permission to relocate Hood Avenue from its planned location on the subject property to a location further to the west. The Deschutes County Planning Division has advised the applicants that a comprehensive plan amendment to the SUA Transportation Plan map is needed to show Hood Avenue in the alignment requested by ODOT and the County. As a result, the applicants have filed this application. The requested relocation of Hood Avenue will require the applicants to dedicate additional right-of-way for Hood Avenue from the subject property. The relocation of Hood Avenue will leave a portion of the current, undedicated Hood Avenue right-of-way shown on MP -80-103 unneeded. The applicants have submitted an application to vacate a portion of the undedicated right of way with the Deschutes County Public Works Department. The Sisters Planning Commission and the City of Sisters have been working to develop a revised comprehensive plan for the Sisters urban area. The Planning Division has solicited comments from affected agencies and departments. Comments received include the following responses: A. Deschutes County Building Division: No comments. B. Property Address Coordinator: All proposed new road names must be approved by the property address coordinator. C. Deschutes County Environmental Health: A septic site evaluation is required for each parcel. D. Deschutes County Transportation Planner: No comments regarding the proposed plan amendment. E. Watermaster - District 11: Our records show ground water irrigation water rights on these properties. The applicant needs to transfer the rights from the land being developed. The water rights maybe subject to abandonment if development occurs prior to moving the water rights. F. Deschutes County Assessor: No comments. G. Sisters Fire Department: This property is wholely within Sisters Camp Sherman RFPD not Cloverdale. H. Oregon Department of Transportation: No comment. PA -97-3 Page 6 �162:-0509 I. Deschutes County Public Works: The old right -way of Hood Street, originally shown in the Hood Street partition is to be vacated. (We are going through the process of vacating this right-of-way although we have not been able to finds that it was ever recorded as a dedicated public road. 9. PUBLIC NOTICE AND COMMENTS: The Planning Division sent written notice of the public hearing in this matter to owners of all property located within 250 feet of the subject property and published notice of the initial public hearing in the Bend "BULLETIN". Staff received no letters regarding this application. However, two requests for copies of the submitted application were requested and provided. APPLICABLE CRITERIA: 1. Staff finds that Title 21 of the County Code, Sisters Urban Area Zoning Ordinance is applicable only to the subdivision application that has been withdrawn, at this time, and not the proposed comprehensive plan map and text amendments. Therefore, staff will not review the Sisters Urban Area Zoning Ordinance for the proposed plan map and text amendments as outlined above under Basic Findings #7. 2. Transportation Element. The Transportation Element of the Sisters Urban Area Comprehensive Plan (SUACP) contains the following provisions that staff finds relevant to the applicant's Plan Map amendment requests: THE ROAD NETWORK SYSTEM There are three primary roles for a road network: traffic mobility, land access (access to property) and the provision for utility service lines (water, sewer, electricity, etc.). There are five basic road classifications used for all County roads, based on the type of service they provide: 1. Principal arterial - carries the major portion of trips entering and leaving the urban area and outlying rural and recreation area. 2. Minor Arterials e. Urban minor arterial - interconnects with and augments the principal arterial system and provides service to intra-urban/intra-community areas. f. To continue development of an urban area system of arterial, collector and local streets to move traffic efficiently to and from all functional areas of the city and provide for their logical extension to future development areas. 4. To provide for an on-going review of the Transportation Element. 5. Traffic congestion on Cascade Street, which carries all highway traffic through the City, is a critical problem. 6. A one-way traffic couplet is one possible solution to reduce traffic congestion along Cascade Street. 7. Cascade Street is not capable of accommodating the projected traffic for the planning period without major modification. g. Financing to meet transportation needs is a critical problem. POLICIES: 1. In order to reduce or eliminate congestion on Cascade Street, the City and State Highway Department should develop a program to separate directional traffic, utilizing Hood Street for eastbound traffic and Cascade or Main Street for westbound traffic. 2. The major traffic -carrying streets shall be Camp Polk Road (Locust Street), Three Creeks Lake Road (Elm Street), US Highway 20 and Oregon State Highways 126 and 242. These streets will be connected by a "beltline" system of collector and local streets. Comprehensive Plan Amendment Criteria. The Sisters Urban Area Comprehensivedthe life of recognizes plan. The plan is intended to be a guide for the future growth of the community. it should be subject to periodic review and should be flexible, but not so flexible as to be meaningless as a statement of community policy. Changes in the plan should be made in light of considerations relating to all or part of the community rather than to who owns the property. It is recommended that the plan be reviewed by the Planning Commission every year to whatever degree is necessary to insure that it is continuing to function as a guide for community growth. In addition, it should be possible for individuals to petition for changes or amendments to the plan in a manner similar to that for zone changes. There must be a public hearing before the Planning Commission and the Governing Body prior to making any changes. Any changes should be consistent with the goals, objectives, policies and statements of intent of the plan or these guidelines should first be changed or amended to reflect the new policies. This should be true of both changes resulting from periodic Planning Commission review and from individual petitions. Hearings on plan amendments shall follow the amendment procedures set forth in the ordinance adopting the Plan. (p.108) FINDING: The applicants have provided detailed findings for the proposed Comprehensive Plan/Map amendments in order to demonstrate compliance with the plan amendment applicable criteria. This analysis, identified on pages o'1 through 73 of the submitted burden of proof is incorporated into the record. Staff concurs with the provided findings and it is staff's opinion the applicants have satisfactorily addressed relevant goals, policies and criteria listed in the Sisters Urban Area Comprehensive Plan for the proposed plan amendment. 3. The applicants have submitted information regarding the Statewide Land Use Goals. The findings, identified on pages 73 through 77 of the submitted burden of proof are incorporated into the record. Planning staff concurs with the applicant's analysis and finds applicants have satisfactorily addressed the Statewide Land Use Goals relevant to the proposed plan amendement. 4. TRANSPORTATION PLANNING RULE: OAR 660-12-060 Plan and Land Use Regulation Amendments Review of this rule establishes that the proposed Plan map and text amendments significantly affect a transportation facility, requiring the applicants to address the requirements of OAR 660-12-060(1), as discussed below. (1) Amendments to functional plans, acknowledged comprehensive plans, and land use regulations which significantly affect a transportation facility shall assure that allowed land uses are consistent with the identified function, capacity, and level of service of the facility. This shall be accomplished by either: (a) Limiting allowed land uses to be consistent with the planned function, capacity and level of service of the transportation facility; (b) Amending the TSP to provide transportation facilities adequate to support the proposed land uses consistent with the requirements of this division; or (c) Altering land use designations, densities, or design requirements to reduce demand for automobile travel and meet travel needs through other modes. (2) Determinations under so affected t transportation rule shall be coordinated with facility and service providers and other affected local governments. This should be confirmed or denied by the Planning Commissions. Approval by the Planning Commissions serves as a recommendation to the Board of County Commissioners `and City of Sisters City Council. If the Planning Commissions move to approve the request, staff asks that the motion include direction to the Planning Division staff to prepare findings and conclusions for review and possible adoption by the Board of County Commissioners and the City of Sisters City Council at a joint public hearing. 0 PA -97-3 Page 11
