WHEREAS, the Board of County Commissioners for Deschutes County, Oregon finds that the inventory
of personal property of arrestees and detainees in necessary to ensure that all arrestee/inmate personal property is
received, inventoried, stored and released in a safe, secure and systematic manner, in accordance with the law; and
WHEREAS, this policy ensures the safety of the facility through effective weapons and contraband control,
and establishes authority to conduct inventories of the personal possessions of arrestees during pre -booking, the
booking process, or lodging at the Deschutes County Criminal Justice Facility; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS
as follows:
Section 1. Adoption. Deschutes County Adult Policy No. 3.025, Arrestee/Inmate Property Receiving,
Inventory, and Storage, is hereby adopted as set forth in Exhibit A, attached hereto and by this reference
incorporated herein.
Section 2. Severability. The provisions of this ordinance are severable. If any section, sentence, clause or
phrase of this ordinance is adjudged to be invalid by a court of competent jurisdiction, that decision shall not affect
the validity of the remaining portions of this ordinance.
Section 3. Emergency. This ordinance being necessary for the immediate preservation of the public peace,
health and safety, an emergency is declared to exist, and this ordinance takes effect on its passage.

I. POLICY: It shall be the policy of the Deschutes County
Criminal Justice Facility (DCCJF) to ensure that all
arrestee/inmate personal property is received, inventoried,
stored and released in a safe, secure and systematic manner,
in accordance with the law. This policy ensures the safety of
the facility through effective weapons and contraband control;
and establishes authority to conduct inventories of the
personal possessions of arrestees during pre -booking, the
booking process, or lodging at DCCJF.
II. DEFINITIONS:
A. Contraband: Alcohol, firearms, live ammunition,
explosive devices, weapons, drug paraphernalia or any
item that if possessed by the arrestee would constitute
a crime or evidence of a crime. Any item which presents
a safety and/or security concern to the DCCJF, staff, or
arrestee shall be considered contraband.
B. Personal Property: Includes, but not limited to, all
clothing, jewelry and money.
C. Confiscated: To take possession of by or as if by public
authority.
III. PROCEDURES
A. Purpose: The purpose of the search is to inventory the
property of the arrestee to protect private property,
reduce or prevent false claims for lost or stolen
property, and protect people and property from any
hazardous condition or instrument that may be with an
arrestee's personal property.

B. Processing and/or Lodging: When an arrestee is brought
to the DCCJF for processing and/or lodging, all personal
property shall be inventoried. Property shall be
searched to ensure no weapons, drugs, or contraband items
are brought into the DCCJF and authorized property is
properly stored.
C. Contraband: Any item that may cause concern for the
safety and/or security of the DCCJF, staff, or
arrestee/inmate shall be considered contraband and may be
confiscated.
D. Property of Arrestee - Pre -Booking Process: Personal
property from the arrestee's pockets, (money, wallet,
etc.) outer clothing, purses, jewelry, belts, or other
items deemed appropriate will be removed, inventoried,
searched, and documented on the Custody Intake
Information Form No. 307 and safely stored. Officer and
arrestee will sign Custody Intake Information Form No.
307, noting the confiscation of property taken.
Property Not Accepted into DCCJF:
1. All contraband, including, but not limited to,
alcohol, firearms, live ammunition, explosive
devices, drug paraphernalia, mace, pepper spray,
knives with blades 4" in length or longer, or any
item that is possessed by the arrestee that would
constitute a crime or evidence of a crime, or the
proceeds from a crime (i.e., stolen property); or
any item which impinges on the safety or security
of the facility.
2. Large, bulky items which cannot be stored in the
arrestee's property box (i.e., backpacks, guitars,
bicycles) .
3. Perishable items such as food, plants, etc.
If during the inventory, items are discovered that are
not allowed into this facility, the corrections officer
will not accept property and the arresting or
transporting officer shall be required to retain these
items.
All items of an arrestee's personal property that are
retained by the arresting or transporting officer shall

r remain the responsibility of the officer who retains the
items. The DCCJF shall not be responsible for the
safekeeping or return of these items.
G. Property of Arrestee - Booking Process: All items of an
arrestee's personal property that are accepted by the
DCCJF shall be inventoried and logged in the Jail
Management Computer System. An inventory of all property
in the inmate's possession at the time of lodging, not
excluded under Paragraphs D(1), (2) and (3), will be
conducted in the following manner:
1. Clothina: Inmate's clothing and pockets will be
searched to ensure all property is inventoried.
Clothing will be listed by item and color.
2. Money: All money will be counted in the presence
of the inmate, recorded, logged in the commissary
computer system, placed in zip -lock bag with proper
documentation and placed in locked box in the
property room.
3. JewelrX: Items such as rings, bracelets, necklaces
and watches will be listed by color and
description, (i.e., yellow metal ring with clear
stone, white metal necklace with red stone).
4. Miscellaneous Items: Small pocket items (i.e.,
pens, comb, nail clippers, etc.) will be
inventoried by item and description.
5. Other Monetary Items: Check numbers shall be
inclusively noted, and the total value of food
stamps will be tallied and entered into the
computer system. Any other items of monetary value
will be entered by description and amount (i.e.,
money orders, issued checks, lottery tickets).
H. Retained Property: Items retained by the inmate must be
approved by the DCCFJ staff and shall be retained by the
inmate at his or her own risk. The DCCJF shall not be
responsible for the safekeeping of these items. Below
listed items will be placed on the Property Inventory
List and noted that the inmate has in his/her possession.
The inmate may retain possession of the following items:

1. Underwear, provided it is not swimwear or gym
trunks. Female inmates may also retain a non -
underwire bra.
2. Inmate medication specifically, nitroglycerin
tablets, nitroglycerin lingual aerosol, transdermal
patch, or asthma nasal inhaler.
3. Prosthetic devices refer to Medical Policy No.
5.320.
4. Medic -alert bracelet or necklace approved by DCCJF
command staff. Medic -alert bracelet or necklace
will be approved unless it poses a safety and
security risk to the facility, staff or inmate.
I. Property Report: After all of the inmate's property has
been inventoried and recorded in the Jail Management
Computer System, the property form shall be signed by the
inmate and the corrections officer indicating the
accuracy of the inventory. A copy of the Inmate Property
Form shall be given to the inmate as a receipt for the
property confiscated by the DCCJF. Copies shall also be
placed in the inmate's property container, and the
inmate's Identification File.
If the inmate cannot or will not sign the Property Form,
the booking employee shall note this on the signature
line.
J. Storage of Inmate Property: All inmate property, except
money, shall be placed and stored in a specifically
numbered container in the property room. Smaller items
will be placed in a small bag for safekeeping and stored
in the same container used for the clothing. The
container number will be placed on Inmate Property Form.
K. Removal of Inmate Property: Once the inmates property is
inventoried and placed in a property container, the items
will not be removed unless authorized by a search warrant
or DCCJF command personnel. The work release coordinator
may transfer the inmate's property to another locker in
the facility.
L. Release of Inmate Property: While lodged at the DCCJF,
inmates shall not be allowed to release any property to
any persons unless the release is approved by DCCJF
command. In most instances, requests to release inmate

property shall be denied unless DCCJF command staff
determines that the release is necessary to prevent
hardship to the inmate's family. In these rare cases,
the release of property shall be a one-time transaction.
If property is released, a Property Release Form No. 305,
shall be completed, signed by all required parties and
filed in the Inmate's Identification File.
M. Accepting Property for Inmates: Inmates lodged in the
DCCJF shall not be allowed to receive any property from
outside the facility. Exception: Money Orders or cash,
religious material (soft -covered books), outer clothing
for inmates going to trial, and approved medical items,
including medication, approved by Facility medical staff.
Items accepted for inmates shall be inventoried,
searched, documented in Jail Management Computer System,
and placed in proper storage container. A receipt will
be provided to the person leaving the items.
N. Inmate Release from Custody: When an inmate is released
from the DCCJF, all inmate property received during
booking shall be accounted for and returned to the
inmate. After releasing property, the Corrections
Officer and inmate shall sign the Property List Form as
verification that all property held by the DCCJF has been
returned to the inmate. If any discrepancy arises
concerning inmate property or funds, every effort will be
made to resolve the issue. If the issue cannot be
resolved, a report shall be forwarded by the Corrections
Officer releasing the property to their supervisor
detailing the circumstances.
