County, Oregon; Describing the Road(s) to be Improved; +' Designating Where the Improvements Shall be Made; Defining the Nature of the Improvements; and Referring this Resolution to the Engineer for Completion of a Feasibility Study.'' cn RESOLUTION NO. 97-095 WHEREAS, the owners of property abutting the proposed improvement of all of 85th Street, Robin Avenue, Oriole Lane, Quail Lane and Limestone Avenue and portions of 78th Street, 85th Place, 76th Street and 73rd Street in Deschutes County, Oregon, have requested the Board of County Commissioners to improve this/these road(s); and WHEREAS, it appears that such road(s) should be improved; and WHEREAS, it appears that it is in the public interest that the Road Department of Deschutes County, Oregon, perform the required feasibility study for this improvement; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows.- Section ollows: Section 1. That proceedings be initiated to improve all of 85th Street, Robin Avenue, Oriole Lane, Quail Lane and Limestone Avenue and portions of 78th Street, 85th Place, 76th Street and 73rd Street to Deschutes County Rural Local Road Standards for the benefit of the area described in Exhibit "A", attached hereto and by this reference incorporated herein. Section 2. That the dedicated road(s) to be improved within the district described in Section 1 of this Resolution are all of 85th Street, Robin Avenue, Oriole Lane, Quail Lane and Limestone Avenue and portions of 78th Street, 85th Place, 76th Street and 73rd Street, shown on the map, Exhibit "B", attached hereto and by this reference incorporated herein. 1 - RESOLUTION NO. 97-095 JUL 16 1997 ��•iE,r'R N - ED �__ 1997 0162--1622 Section 3. The road(s) to be improved as a result of this Resolution shall be improved to County Rural Local Road Standards. Section 4. Improvements to be made to the roadway within the district include, but are not limited to, reconstruction of the roadway to a 25 foot wide paved road with 4 foot aggregate shoulders, and adequate drainage, as well as related engineering, administration, mobilization and traffic control work. Section 5. This Resolution shall hereby be referred to the Engineer for completion of a feasibility study in accordance with Chapter 12.48.150 of the Deschutes County Code. The Engineer may engage the services of any qualified engineer for all or part of the investigation required under Chapter 12.48.150 of the Deschutes County Code. DATED this day of u 1997. DATE: June 30, 1997 61150 S.E. 27th St., Bend, OR 97702 (541) 388-6581 - FAX (541) 388-2719 The Road Department received petitions from forty-five property owners within the suggested boundaries of the Limestone LID located in the First Addition to Whispering Pines subdivision to start a Local Improvement District (L.I.D.). There are one hundred fifty-six lots that would be benefited by the roads in the Limestone LID being improved, the forty-five petitions represent 29% of the property owners. According to County Code at least 25% of the owners must sign the petition. Received with the petition were checks for the $800 filing fee. Forty-one different property owners paid a portion of the fee. If the roads are improved, by the LID, each of the 41 lots would have the amount paid ($10 or $20) credited against the lot's assessment. The 4.3 miles of roads included within the Limestone LID are: all of 85th Street, Robin Avenue, Oriole Lane, Quail Lane, and Limestone Avenue; also included are portions of 78th Street, 85th Place, 76th Street, and 73rd Street. Cost to improve these roads to County standards is estimated to be $1,135,500 or $7,500 per benefited lot. 2.6 miles of the roads were included. within the 85th Street LID, which failed last year. The Road Department recommends that the Board approve Resolution No. 97-095 to initiate the Limestone Local Improvement District. If the Board decides to initiate the Limestone L.I.D. , the next step in the process will be for the engineer to complete a feasibility study.
