"J Certain Property Located in the Bend Urban Area to Surface Mining, and Declaring an Emergency. - rT ORDINANCE NO. 97-055 r = ° ry µ WHEREAS, 4-R Equipment, LLC, submitted a request for a quasi-judicial amendment to the Bend Area General Plan Map to change the plan designation for certain property from Residential to Surface Mining; and WHEREAS, the Deschutes County Hearings Officer approved the proposed plan map amendment after a hearing was held on June 17, 1997, and the decision of the Hearings Officer has not been appealed; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDAINS as follows: Section 1. ADOPTION OF PLAN MAP AMENDMENT TO CHANGE PLAN DESIGNATION. The Bend Area General Plan Map adopted pursuant to Ordinance 80-216 is amended to change the plan designation for the property described in Exhibit "A," and as shown on Exhibit "B," attached hereto and by this reference incorporated herein, from Residential to Surface Mining. Section 2. FINDINGS. EMERGENCY. This ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this ordinance takes effect on its passage.
