Urban Growth Boundary Zoning Ordinance,
of the Deschutes County Code and
Declaring an Emergency.
ORDINANCE NO. 97-081
WHEREAS, Brooks Resources Corporation applied for a plan amendment and zone change on
certain properties within the Bend Urban Growth Boundary; and
WHEREAS, a hearing was held, after notice given in accordance with law, before the County
Hearings Officer; and
WHEREAS, the Hearings Officer approved the proposed zone changes on certain properties; and
WHEREAS, the decision of the Hearings Officer has not been appealed; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDAINS as follows:
Section 1. AMENDMENT. Title 19 of the Deschutes County Code is amended to change the
zone designation of the property described as Parcels 1, 2, 3, 4, 5, 7 and 8 on the attached Exhibit "A,"
attached hereto and incorporated herein, and as generally depicted on Exhibit `B" attached to Ordinance
97-080, and incorporated herein by this reference, from Urban Standard Residential Zone (RS) to Limited
Commercial Zone (CL).
Section 2. FINDINGS. The Board of County Commissioners adopts as its decision and findings
in support of the above -referenced zone changes the Decision of Deschutes County Hearings Officer,
dated September 23, 1997 relating to zone change application No. ZC-97-3, marked as Exhibit "D" to
Ordinance 97-080, and incorporated herein by this reference.

Section 3. EMERGENCY. This Ordinance being necessary for the immediate preservation of the
public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its
passage.
