L;F t r `� �4 ORDER NO. 97-164 COU I Y C L E IR, WHEREAS, ORS 357.216 to 357.286 authorizes the formation of a library district in Deschutes County, Oregon; and WHEREAS, the Board of County Commissioners of Deschutes County, Oregon (Board) has received a document entitled "Proposal to Foran the Deschutes Public Library District," marked Exhibit "A," attached hereto and by this reference incorporated herein, from its Library Advisory Board; and WHEREAS, ORS 198.835 authorizes the Board to initiate the formation of a library district located entirely within Deschutes County, Oregon, by order of the Board; and WHEREAS, the Board finds that there is a need for a library district in Deschutes County, Oregon, and that it is in the public interest to initiate the formation of the library district as proposed in Exhibit "A" to this order; and WHEREAS, the Cities of Bend. Redmond and Sisters, by proper resolution, certified copies of which are marked Exhibits "B," "C" and "D," attached hereto and by this reference incorporated herein, approved the order initiating the formation of the Deschutes Public Library District pursuant to ORS 198.835(3); now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. The Board of County Commissioners of Deschutes County, Oregon, hereby declares its intention to form the Deschutes Public Library District pursuant to ORS 357.21.6 to 357.286. Section 2. The library district shall be named the Deschutes Public Library District. Section 3. The boundary of the Deschutes Public Library District is the boundary of Deschutes County as set forth in ORS 201.090 and depicted on the map of Deschutes County, respectively marked Exhibits "E" and "F," attached hereto and by this reference incorporated herein. Section 4. Pursuant to ORS 357.231, the proposed Deschutes Public Library District, if formed, will have, five (5) district board members elected by zones. The zones for the five board members are as set forth in Exhibit "A," page 6, and depicted on the map marked Exhibit "G," attached hereto and by this reference incorporated herein. Section 5. The proposed Deschutes Public Library District, if formed, will have a permanent rate limit for operating taxes of $0.55 per $1,000 assessed value which will raise an estimated $3,479,000 in operating funds for the District in the 1998-99 fiscal year. Section 6. That a hearing on the order of the Board of County Commissioners initiating the formulation shall be at 10 a.m. on January 21, 1998, in Hearing Room A, Juvenile Justice Building, 1128 NW Harriman, Bend, Oregon. r 1 - ORDER No. 97-164 (12-17-1997) 0163=12"13 Section 7. Notice of Hearing shall be given in substantially the form set forth in Exhibit "ll." attached hereto and by this reference incorporated herein. The recording secretary shall cause the notice to be published in The Bulletin on January 5 and 14, 1998, and posted on January 5, 1998, in three public locations within the county as follows: one notice shall be posted on or near the doors of the meeting room of the Board of County Commissioners; one notice upon any official bulletin board customarily used for the purpose of posting public notices within the county; and one notice shall be posted upon any official public bulletin board customarily used for the purpose of posting public notices within the proposed district. Notices posted shall be for not less than five (5) consecutive days. Section 8. The Director of the Deschutes County Community Development Department shall cause to be filed with this Board prior to January 21, 1998, a land use compatibility statement regarding this proposed special district formation as contemplated in ORS 197.175 and 199.462, and any other applicable statutory authority. Each of the five library advisory boards have participated in the design of the proposed library district. Library and county administration worked with legal staff to analyze requirements and to develop appropriate timelines. The Oregon State Library and the Special District Association were also consulted. FINAL DRAFT EXHIg�T Page 0163.1 The Library Mission The five branch libraries of the Deschutes Public Library are important community centers that promote literacy and learning, and provide equal access to information for all the citizens of Deschutes County. Literally thousands of Deschutes County residents visit their local library every day to solve real problems and to pursue a life-long commitment to learning. Typical uses include: ♦ Artists peruse periodicals, art history books, and method guides ♦ Citizens review newspapers, magazines, and government documents to track the Last Year 455,825 visits were recorded at the five facilities. 730,000 items were circulated. 35,606 requests for information were submitted to reference librarians. 600 local residents paid dues to become Friends of the Library. 190 volunteers are currently working on a countywide campaign to replace lost book budget funds. actions of local, county, state, & federal government agencies ♦ Consumers research purchase decisions ♦ Entrepreneurs develop marketing skills and business plans ♦ Family members research medical diagnosis and prescribed medications ♦ Homeowners plan gardens and research home repair and remodeling ♦ Investors consult financial tools such as Value Line and Wall Street Journal ♦ Job candidates refine resumes and interview skills ♦ Life-long readers peruse recent publications or investigate the classics ♦ Mechanics research specifications for automobile repairs ♦ Parents work with preschool students to develop school readiness skills ♦ Students research school assignments EXHIBIT. Deschutes Public Library District - 2 - a A Library In Crisis The Deschutes Public Library System is in crisis. Funding for library operations stagnated and then declined during the 1980s and 1990s even as the demand for library services and the dawning of the Information Age required the library to reinvent itself. Every county department has stretched to meet the needs of a population that has essentially doubled over the past two decades. Competition for limited resources has been fierce. Despite strong community support, the library program has been unable to successfully compete with departments that provide mandated services. The gradual erosion of library services reached a climax in the 1997/98 fiscal year. Staff was cut by over 16%, the libraries closed on Mondays and reduced evening open Over the past twenty years ♦ The "demographic landscape" changed. ➢ The population doubled in size. ➢ The population changed to include a larger percentage of seniors. ➢ Many more residents have attended college. ➢ Annual library circulation increased from 430,000 to 730,000 items. ♦ Library facilities were updated. ➢ La Pine and Sisters opened libraries in the 1980s. ➢ Bend, Redmond and Sunriver constructed larger, state-of-the-art facilities in the 1990s. ➢ Libraries increased from 16,600 to 73,900 square feet. ♦ Information Age technology was implemented. ➢ The card catalog and circulation system were automated. ➢ Library collections were expanded to include videos, cassettes, and compact disks as well as books and microforms. ➢ Microcomputers, local area networks, and the Internet all became standard library tools. hours, and the library book budget was reduced by over 80%. These reductions occurred less than a year prior to the opening of the new facilities in Bend and Sunriver, and less than two years after the dedication of the new Redmond Branch Library. The county commissioners and the budget committee expressed concern for the future of the library program in each of the past three fiscal years. During the 1997/98 budget process, the commissioners urged library leaders to be proactive and develop a plan to achieve adequate, stable funding for library services beginning with the 1998/99 fiscal year. a Deschutes Public Library District - 3 - EXHIBIT Alternatives Oregon Revised Statues permit public libraries to be operated as departments of a municipal corporation such as Deschutes County, as county service districts, or as autonomous special districts. Libraries operating as a county department can be funded from the general fund or from rate levies that must be renewed periodically. Voters approve a permanent tax rate when they form a county library service district or a special library district. The Library Board considered each of these alternatives. The Library Board recommends the formation of an autonomous special library district for the following reasons: Library district taxes are dedicated to library funding. This complete separation of library funding from Deschutes County would allay taxpayer concerns that library funding could be transferred to other county departments. Library leaders agreed that separation of funding will be a key election issue. Library board members are elected and would answer directly to local residents. This method of governance would remove a layer of government between area voters and library operations and insure that the library system responds to local needs. Voters approve a permanent tax rate. Approval of the proposed library district would provide the permanent stable funding that the library requires to build a solid, well-planned program. Library leaders are committed to living within this rate for at least 10 years. This rate could not be adjusted without the specific approval of area voters. EXHIBIT. Deschutes Public Library District - 4 - . 0163=1278 THE DESCHUTES PUBLIC LIBRARY DISTRICT Governance Structure The Deschutes Public Library District would consist of the system headquarters located in the old Bend library and the five branch libraries located in Bend, La Pine, Redmond, Sisters, and Sunriver. The system would be governed by a five-member library board that would be elected by zone to insure wide geographic representation. A district library director, appointed by the library board, would administer the library system. Support services such as automation, acquisitions, building maintenance, finance, and staff development would be centrally coordinated to insure efficient operations. The following would also play key roles in the governance of the library district: ♦ Five branch advisory boards will work with branch managers and the district library board to establish goals and priorities and develop appropriate library policies. ♦ Library facilities in Bend, Redmond, and Sunriver were constructed with voter approved bonds issued by local county service districts. These county service districts will continue to exist in order to service the outstanding bonds. The library district would lease these facilities for a $1 nominal fee. ♦ Five independent Friends of the Library groups will continue to provide support services and assist in local library development. ♦ The Deschutes County Public Library Foundation will continue to work with the library leadership to solicit grants and endowments to supplement library funding. EXHIBIT Deschutes Public Library District - 5 - Page `�� 0163=12'9 DESCHUTES PUBLIC LIBRARY ZONES All five advisory boards endorsed the proposal to elect candidates from specific zones in order to insure broader representation on the district board and reduce election costs. Oregon Revised Statutes (ORS) require that each of the five zones have approximately equal population based on the most recent (1990) census. The county clerk, county planning department, and the county library board worked together to draw the five zones. The library board and staff were faced with the dilemma of drawing zones that adhere to the statutory requirements but also reflect defined communities within Deschutes County. The Redmond and Bend areas contained sufficient population to allow the Board to draw zones which meet the "common sense" test. Other "natural" areas lacked the population base to meet statutory requirements. The Board had little choice but to add several remote precincts to the zone that includes the Sister's area, and by necessity added precinct 26 to the zone that includes the Sunriver & La Pine areas. Municipal corporations routinely adjust zones as new census data becomes available. The library board recommends that the newly elected district library board review the zones at the earliest convenience. It is important to note that board members elected from a zone are not representatives of a specific branch library. The zones are only a mechanism to insure broad geographic representation on the district board. The five branch advisory boards will continue to operate with the charge of advising the district library board on matters of policy. Proposals were developed with the following considerations: ♦ Staffing requirements for local facilities in Bend, Redmond, and Sunriver, and anticipated expansions at Sisters and La Pine. ♦ Comparisons with recommended standards prepared by the Oregon Library Association. ♦ Comparisons with library systems serving similar sized populations. ♦ Technology requirements for a library system serving 100,000 residents with five branch libraries. Community Response Deschutes County residents want to accomplish four objectives by forming the library district: Get off the roller coaster. Deschutes Public Library has historically moved from funding crisis to funding crisis. Library supporters want to bring a level of stability to the program. Operate a Quality Program. Deschutes has outgrown the bare -bones library program. Library leaders want to build a quality program that provides the same level of services offered in similar sized communities. Keep the Libraries Open. Local taxpayers have built three new libraries in recent years. Residents value libraries and want these facilities to be open convenient hours. Fill the Shelves. "We have all these empty shelves - where are all the books," commented more than one Redmond resident. The message from Redmond was typical of feedback from all the branch libraries - build the library collection. The new libraries in Sunriver and Bend will require a significant investment in the collection. EXHIBIT Deschutes Public Library District - 7 - Page Specific Services System Services 0163-1281 System headquarters will move into the old Bend library in the fall of 1998. Initially, administrative offices will be housed in this facility. Collection development and technical services will move to system headquarters within five years. The proposed budget incorporates funding for the following services: ♦ Administration, including Finance, & Personnel ♦ Building Maintenance ♦ Professional support for children's services for La Pine, Sisters, and Sunriver ♦ Collection development ♦ Courier Service ♦ General Liability & Property Insurance ♦ Legal Services ♦ Technical services, including support for the wide area network and library automation Many of these services will be obtained through contractual agreements with other municipal corporations or by outsourcing to private enterprise. Redmond Branch Library The Redmond Public Library moved from a 2,000 square foot facility to the new 22,000 square foot facility in 1996. This new facility doubled the shelving capacity, and introduced a separate children's area. The proposed budget incorporates funding for the following services: ♦ 82% increase in the library collection to 51,000 current items within 6 years ♦ 32% increase in open hours - open every day including Sunday afternoons and 4 evenings ♦ Professional children's librarian to staff children's area ♦ Quick response to requests for reference assistance ♦ Adequate building maintenance and janitorial service EXHIBIT Deschutes Public Library District - 8 - 0163-1282 Bend Branch Library The Bend Public Library will move from a 14,000 square foot facility to the new 40,000 square foot facility in the Fall of 1998. This new facility increases shelving capacity by more than 50%, houses an expanded children's area, and incorporates Information Age technology. New library facilities result in increased usage. Based upon the experience of similar libraries, circulation and reference should increase by 30% to 50% within five years. The proposed budget incorporates funding for the following services: ♦ 42% increase in library collection to 171,000 items within 6 years ♦ 31% increase in open hours - open every day including Sunday afternoons and 4 evenings ♦ Support for local area computer network maintenance ♦ Adequate building maintenance and janitorial service ♦ Quick response when checking out materials or requesting reference assistance, including renewals and ready -reference by telephone ♦ Expanded children's services, including support for local daycare centers, Boys 8v Girls Club, and other agencies that promote school readiness. La Pine Branch Library The La Pine Public Library is located in an inadequate facility which should be expanded or replaced within the next five years. The proposed budget incorporates funding for the following services: ♦ 67% increase in library collection to 23,500 items within 6 years ♦ 43% increase in open hours - open every day including Sunday afternoons and 2 evenings ♦ Improved service during peak periods ♦ Support from a professional children's librarian ♦ Adequate building maintenance and janitorial service EXHIBIT. Deschutes Public Library District - 9 - 0163-1283 Sisters Branch Library The Sisters Public Library is located in an attractive facility that should be expanded within the next five years. The proposed budget incorporates funding for the following services: ♦ 114% increase in library collection to 23,500 items within 6 years ♦ 43% increase in open hours - open every day including Sunday afternoons and 2 evenings ♦ Improved service during peak periods ♦ Support from a professional children's librarian ♦ Adequate building maintenance and janitorial service Sunriver Area Branch Library The Sunriver Area Public Library will move into the new 6,800 square foot facility in the spring of 1998. This new facility will feature a children's area, a large meeting room, and increased seating. The proposed budget incorporates funding for the following services: ♦ 142% increase in library collection to 17,000 items within 6 years ♦ 43% increase in open hours - open every day including Sunday afternoons and 2 evenings ♦ Improved service during peak periods ♦ Support from a professional children's librarian ♦ Adequate building maintenance and janitorial service EXHIBIT ____.1 Deschutes Public Library District - 10 - Page 0163=1284 Sample Budget This Sample Budget reflects the priorities recommended by the five advisory boards and endorsed by the county library board as discussed in the previous section. All libraries would be open every day of the week with extended evening hours, children's services would be expanded, and the collection of books and AV materials would be expanded to 286,000 items within six years. The Sample Budget assumes: The library district will issue tax anticipatory notes during the first several years of operation until such time as ending cash balance is sufficient to fund operations through November when tax receipts are deposited. The County will allocate $375,000 for library services during the 1998/99 fiscal year. These funds would be used to offset indirect costs assigned to other departments that provide infrastructure and administrative support. This action would allow for a smoother transition as the Library District assumes responsibility for these services, and will provide stability for other county departments during the 1998/99 fiscal year. This Sample Budget demonstrates the feasibility of the service plan outlined in this document. The actual budget would be reviewed and adopted by the elected district board following budget law outlined in the Oregon Revised Statues. In instances in which libraries were not funded by a separate levy, tax rates were calculated by dividing the general fund transfer by the assessed valuation. It was not feasible to calculate a meaningful tax rate for several systems that are funded by a combination of county and city tax rates with overlapping jurisdictions. Some specific properties with stagnated or reduced market value may experience compression resulting in a small revenue loss (less than 1%) for the library district as well as other municipal corporations. The county appraiser's best estimate is that few if any properties would be placed under compression by the formation of the library district. Deschutes Public Library District - 12 - EXHIBIT 0163-1286 TRANSITION Library services will not be interrupted if the proposal to form the Deschutes Public Library District is approved by area voters at the May 1998 election. The Library District will rely upon Deschutes County for support and guidance during the first year of operation and many administrative services will be provided by the County via intergovernmental agreement. The Library District will need to work with the County to resolve a number of issues, including the transfer of library property and employees. The county library board and library administration will work with the county administrative staff to develop preliminary agreements that would then be reviewed and ratified by the elected district library board. The county library board and library administration will work together to prepare a proposed budget for the 1998/99 fiscal year. The newly elected library board would immediately convene a budget committee to review and adopt the proposed budget. POLITICAL CONSIDERATIONS There are a number of reasons to suggest that the proposal to form the Deschutes Public Library District will be successful. Indicators include: ♦ Strong voter support from the Redmond community in support of a library bond in 1995. ♦ Strong voter support from both the Bend and Sunriver communities in support of library bond issues in 1995 and 1996. ♦ Strong Friends of the Library organizations in five communities. ♦ An active volunteer program. EXHIBIT Deschutes Public Library District - 13 - Page 0163-128' ♦ Active leadership within the county library board and each of the five branch library boards. ♦ A substantial portion of area residents actively use the five libraries. ♦ Library leaders perceive that the community agrees that drastic action is needed to restore library services. Library leaders have identified several key issues that must be addressed in order to insure approval of the proposed library district: ♦ It would be helpful if the County would identify specific uses for the funds that have historically been appropriated to the library program. This is a County issue, but it will impact the library district election. ♦ It would be helpful if the County would clearly state its intentions regarding the future of county funded library services in subsequent years. What level of library service can local residents expect if the proposed district is not approved? ♦ A clear and enthusiastic endorsement of this proposal by Deschutes County would enhance the likelihood of voter approval. The Board of County Commissioners, of Deschutes County, Oregon, has entered an order declaring its intention to initiate this formation. The boundaries of the proposed district are the boundaries of Deschutes County as described in ORS 201.090. The proposed Deschutes Public Library District will include all of the territory within Deschutes County including incorporated areas of the C ities of Bend, Redmond and Sisters. The proposed district shall be referred to as the "Deschutes Public Library District." The proposed district has a proposed permanent tax rate limit for operating taxes of $0.55 per thousand dollars assessed value which will raise an estimated $3,479,000 in operating finds for the district in the 1998-99 fiscal year. The purpose of the proposed formation is to provide library services for the inhabitants within Deschutes County in accordance with ORS 357.216 to 357.286. The proposed district will have five (5) district board members elected by zone. All interested persons may appear and be heard. The meeting location is wheelchair accessible.
