REVIEWED LE COUNSEL BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON A Resolution Classifying Fees * 98 JAN 26 AM 11: 26 And Charges Pursuant to Senate * MARY SUE:- r B"HOLLOW Bill 1215 of 1997. * COUNTY CLERK RESOLUTION ON. 98-007 WHEREAS, Ballot Measure 50 has been approved by Oregon voters, adding Section 11(19), Article XI of the Oregon Constitution, requiring the legislative assembly to limit fee increases by local taxing districts; and WHEREAS, Senate Bill 1215 of 1997 limits fee increases by local taxing districts and establishes standard procedures by which: (1) Local taxing districts may determine if their use of a funding mechanism during the initial implementation period to fund government products and services constitutes a shift prohibited by Section 11(19), Article XI, of the Oregon Constitution, and (2) The public may challenge the determination of a local taxing district on the application of the shift prohibition to a proposed fee, fee increase, or a receipt and expenditure of fee proceeds; and WHEREAS, Deschutes County is a "taxing district" as defined by Senate Bill 1215; and WHEREAS, it is necessary and appropriate to increase various Deschutes County fees; and WHEREAS, it is necessary to comply with the provisions of Senate Bill 1215 in order to classify funding mechanisms as not prohibited by Section 11(19), Article XI, of the Oregon Constitution; and WHEREAS, pursuant to Senate Bill 1215, the County published written finding on January 11, 1998, for each funding mechanism created or increased in this resolution; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, as follows: KEY$ CHER MICROFILMED JAM 1998 -7 1n 41998 1 - RESOLUTION NO. 98-007 0163.20'79 Section 1. This resolution supersedes any prior resolution or action to the extent the prior resolution or action establishes or requires collection of fees or charges of the type specified herein.
