ORDER NO. 98-005 98 FEB 26 PH 1: 55 MARY SUE PENHOLLOW COUNTY CLERK WHEREAS, ORS 275.100 provides that Deschutes County may exchange real property with private persons when it deems such exchange to be in the best interest of Deschutes County; and WHEREAS, the Board of County Commissioners of Deschutes County did adopt Resolution No. 98-003 on January 7, 1998, providing for a hearing for the exchange of real property between Deschutes County and Cascade Pumice, Inc., The Davenport Family Trust UTD (12/3/86) and Juniper Ridge Ranch; and WHEREAS, said hearing was held on February 25, 1998; and WHEREAS, the Board of County Commissioners finds that the real property generally described herein of equal value and the exchange of the real property is in the best interest of Deschutes County; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, AUTHORIZES AND ORDERS as follows: Section 1. The real property to be transferred by Deschutes County is generally described as follows: That portion of Government Lot 1, in the NE'/4 of the NE'/4 of Section 12, Township 17 South, Range 11 East of the Willamette Meridian, Deschutes County, Oregon, being more particularly described as follows: Beginning at a 2" brass cap marking the NE corner of Section 12, T.17S., R.11 E., W.M.; thence southerly along the section line S 00°02'40" W 1313.18 feet to a 3" aluminum cap marking the East '/161h corner of the NE'/4 of said section; thence N 89047'57" W 1326.52 feet to a'/i" iron rod marking the center of said %4 Section; thence N 00°13'07" W 1316.05 feet to the North line of said section; thence easterly along said North line S 89040'37" E 1332.57 feet to the point of beginning. Excepting therefrom a 60 foot wide portion, being 30 feet on either side of the centerline of Johnson Road. KEYPU' HED MAR '2 199$ 4 PAGE 1 OF 2 - ORDER NO. 98-005 (2/25/98) 0164-0438 The real properties to be transferred by Cascade Pumice, Inc., The Davenport Family Trust UTD (12/3/86) and Juniper Ridge Ranch are generally described as follows: Parcel 1 A tract of land situated in the Northeast Quarter of the Northeast Quarter (NE'/<NE'/,) of Section Thirty-two (32), Township Seventeen (17) South, Range Twelve (12) East of the Willamette Meridian, Deschutes County, Oregon, described as follows: Commencing at a point 872 feet South and 1072 feet West of the Northeast corner of Section 32, in Township 17 South, Range 12 East of the Willamette Meridian, thence South 100 feet; thence East 100 feet; thence North 100 feet; thence West 100 feet to the place of beginning said tract being sometimes described as the Northwest Quarter (NW'/,) of LYTLE ACRE TRACTS no. Twenty-nine (29). Parcel 2 Lot Three (3) in Block Three (3) of NORTHWEST TOWNSITE COMPANY'S (FIRST ADDITION) to the City of Bend, Deschutes County, State of Oregon. Parcel 3 Lot 2 QUARTZ CANYON TRACTS, City of Redmond, Deschutes County, Oregon. Section 2. That upon review and approval of title by the Deschutes County Legal Counsel the exchange of real property as referenced is hereby authorized.
