WHEREAS, Deschutes County has acquired title to certain real property pursuant to
a variety of means, including right of way purchase, exchange and real property tax foreclosure
proceedings on file in the Circuit Court of the State of Oregon for Deschutes County; and
WHEREAS, foreclosure proceedings are completed, and tax deeds in the regular form
have been executed by the Deschutes County Tax Collector and recorded in the Deed Records
of Deschutes County pursuant to ORS 312.200 with respect to real properties acquired by tax
foreclosure; and
WHEREAS, ORS 271.310 authorizes the sale of the real property described in Exhibit
"A" by the Board of County Commissioners; and
WHEREAS, it appears that it is in the best interests of the County to sell the real
property described in Exhibit "A," attached hereto and by this reference incorporated herein,
and that the minimum price set forth after the description of each parcel, be the minimum
price for any said sale; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS as follows:
Section 1. That the Deschutes County Sheriff hereby is authorized and directed to offer
for sale the property described in Exhibit "A," attached hereto and by this reference incorporat-
ed herein, to the highest and best bidders for cash or terms, as determined by the Board of
County Commissioners, but not less than the minimum bid hereby fixed.
Section 2. That said sale is to be made at the Oregon National Guard Armory, 875 SW
Simpson Avenue, Bend Oregon, at 10:00 a.m. on Thursday, May 21, 1998, and that sealed,
written bids on properties not sold on May 1, shall be received by the Deschutes County Sheriff
until 4:00 p.m. on May 27, 1998.

Section 3. All sales shall be deemed conditional until such time as the Board of County
Commissioners formally accepts or rejects said sale and thereafter closes the auction.
Section 4. That the Deschutes County Property and Real Estate Manager is authorized
to take those actions reasonably calculated to efficiently and successfully conduct the
aforementioned land sale auction, including deviation from or modification of sale procedures,
when in the opinion of the Property and Real Estate Manager said deviations or modifications
are justified.

Prospective bidders shall register at the auction and provide an acceptable picture I.D., prior
to bidding. With respect to properties having a minimum bid equal to or in excess of $8,000,
or in the event that the successful bid is $8,000 or above, said property may be purchased with
cash or financed 20% down, balance at 9% interest over 10 years, in equal monthly payments.
Payment of the bid price or down -payment may be made by personal check if drawn upon an
account located within Deschutes County, otherwise payment shall be made by cashiers check
to the Sheriff s deputy conducting the sale, at the time that the high bid is determined. A check
guarantee card will be required for any payment by personal check. Returned or dishonored
checks will be prosecuted to the full extent of the law.
This auction shall be continuous from and after the above sale date until closed by the
Board of County Commissioners. Written offers to purchase any parcel not sold on May 21,
1998, shall be received by me in my offices through the following Wednesday, May 27, 1998,
at 4:00 p.m. and shall be opened at 4:15 p.m. that day in the office of Property and Facilities
Management, 1130 NW Harriman Street, Bend, Oregon. The highest offer for any parcel
which is equal to or exceeds the minimum bid price shall be conditionally accepted. In the
event two or more offers are equal, the offer received first shall be conditionally accepted.
Upon acceptance of such offer, the sale as to that parcel shall be deemed closed. Written
offers must be accompanied by a cashier's check payable to Deschutes County and must
include the complete name and mailing address of the bidder. Offers may be made through
a licensed real estate agent. The County shall pay a five percent (5%) real estate commission
to licensed real estate agents who appear at the sale on behalf of a client whose bid is accepted
by the Board of County Commissioners. Commissions shall not be paid to realtors
representing themselves or any entity in which they have a financial interest. Realtors who
wish to appear at the auction on behalf of a client and therein be eligible for a real estate
commission shall register on May 14 and 15, 1998, at the Property and Facilities Management
Office, 1130 NW Harriman Street, Bend, Oregon and provide a photocopy of their current real
estate license to County personnel. Commissions will not be paid unless the realtor pre -
registers and provides the required documentation at the time of registration.

All parcels are sold as is. Potential bidders should thoroughly investigate all aspects of a
property prior to bidding. Deschutes County has not surveyed the aforementioned real
properties and makes no representation as to boundaries, encroachments or encumbrances.
Deschutes County does not guarantee or warrant that any parcel is buildable, suitable for
septic system, has legal access, is vacant or is usable for any particular purpose. The County
shall not warrant or defend the fee simple title of real property offered for sale to be free of
defects or encumbrances, but will only sell and convey such interest as the County acquired
by foreclosure or other means and holds at the time of sale.
Conveyance is subject to all valid, recorded easements, road right of way dedications and
the right of any municipal corporation to purchase such property pursuant to State law and
subject to the right of the Board of County Commissioners to reject any and all bids. Example
copies of County land sale contract documents are available for review at the office of
Deschutes County Property and Facilities Manager, Deschutes Services Building, 1130 NW
Harriman, Bend, Oregon 97701. Packets of tax lot maps may be purchased from the
Deschutes County Property and Facilities Management at the above address.
