RESOLUTION NO. 98-033
WHEREAS. Deschutes County has entered into radio transmission and receiving site lease
agreements and radio transmission and receiving sublessee agreements (together referred to as
"agreements") with entities that utilize the County's real property to maintain facilities in accordance
with each entity's Federal Communication Commission license; and
WHEREAS, from time to time each entity's agreement may be renewed for an additional term
upon payment of the annual agreement consideration prescribed by the County, and
WHEREAS, the County has conducted a market study to determine the fair and equitable
amount of consideration to be charged for such renewals; and
WHEREAS, the Board of County Commissioners, having received public comment on the
proposed new annual rates for renewal of agreements on its Awbrey Butte property: now, therefore.
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON, as follows:
Section 1. The annual consideration to be paid for the renewal of radio transmission and
receiving site lease agreements between Deschutes County and entities operating under a Federal
Communication Commission license on County property in Bend, Oregon, shall be $6,000 per annum
unless the site is for a single user's own use only, in which case, the annual consideration for renewal
shall be $4,800 per annum.
Section 2. The annual consideration to be paid for the renewal of radio transmission and
receiving sublessee agreements between Deschutes County and entities operating under a Federal
Communication Commission license on a tower located on County property in Bend, Oregon. shall be
$3,000 per annum, except that low power broadcast stations and single users for own use shall be
$2,400 per annum.
Section 3. Public safety users on Deschutes County's tower shall not be charged under the
terms of this resolution.
Section 4. The Board may consider rates for renewals that are less than the amounts set
forth in Sections 1 and 2 of this Resolution for publicly operated low power broadcast stations and
amateur radio users when special circumstances exist.

Section 5. The lease rates for renewals of existing users shall be as set forth on I xhibit "A"
to this resolution and are effective as of the date of this resolution and shall be applied at each
agreements renewal date arising after the date of this resolution.
Section 6. New agreements becoming effective on or after the date of this resolution shall
be charged the amount of consideration set forth in Exhibit "B" to this resolution.
Section 7. The Property and Facilities Management Department shall periodically review
the rates set forth herein to assure that the rates reflect market rates for the use of County property for
radio transmission and receiving.
