RESOLUTION NO. 98-048
WHEREAS, ORS 275.225 authorizes Deschutes County to sell surplus County land by
private sale when the assessed value is less than $5,000.00 and the property is unsuited for the
construction or placement of structures thereon under current zoning ordinances and building
codes of Deschutes County; and
WHEREAS, Deschutes County owns certain real property generally described in
Exhibit "A," attached and by this reference incorporated herein, which is not needed by
Deschutes County; and
WHEREAS, the real property described in Exhibit "A" is unsuited for construction
under current zoning regulations and has an assessed value of $3,000.00; and
WHEREAS, Frank and Eileen Chiechi has requested that Deschutes County sell the
real property described by Exhibit "A" for the assessed value of $3,000.00, plus the transaction
costs chargeable; now therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. That the real property described in Exhibit "A" be sold by private sale
pursuant to ORS 275.225.
Section 2. That notice of the private sale be given as set forth in Exhibit "B," and be
published in the "Bulletin" on May 13, 1998, and posted on the same date.
Section 3. The Board of County Commissioners shall accept written comment on the
proposed private sale through June 2, 1998. Thereafter the Board may sell the real property
described in Exhibit "A" to Keith Cyrus or others, by way of a bargain and sale deed.

Section 4. If the Board sells the real property following the comment period, that
Richard L. Isham, Legal Counsel, acting for and on behalf of Deschutes County, Oregon, shall
be authorized to proceed with the sale of the real property and execute all documents
necessary to transfer the interest of Deschutes County in the real property described in Exhibit
"A" of this resolution.

A tract of land located in Deschutes County, Oregon, in the SWI/4NWI/a of
Section 13, Township 15 S., Range 10, E.W.M. and described as follows:
Beginning at a pont on the Section line between Sections 13 and 14 - SO ° 38154"E
- 1581.85 feet from the NW corner of Section 13, Township 15 S., Range 10,
E.W.M. and running thence SO°38'54"E - 361.5 feet; thence S67048'54"E - 361.5
feet; thence NO°38'54"W - 361.5 feet; to the south side of the Jordan Road;
thence N67°48'54"W - 361.5 feet along the south side of the Jordan Road to the
point of beginning and containing 3 acres, more or less.

PUBLIC NOTICE
The Board of County Commissioners of Deschutes County, Oregon hereby declare its
intent to sell at private sale, pursuant to ORS 275.225, that real property generally described
as follows:
A tract of land located in Deschutes County, Oregon, in the SWl/4NWI/a of
Section 13, Township 15 S., Range 10, E.W.M. and described as follows:
Beginning at a pont on the Section line between Sections 13 and 14 - S0038'54"E
- 1581.85 feet from the NW corner of Section 13, Township 15 S., Range 10,
E.W.M. and running thence SO *38'54"E - 361.5 feet; thence S67 048'54"E - 361.5
feet; thence NO ° 38'54"W - 361.5 feet; to the south side of the Jordan Road;
thence N67048'54"W - 361.5 feet along the south side of the Jordan Road to the
point of beginning and containing 3 acres, more or less.
The assessed value of the real property herein described is $1,000.00. The private sale
as described in the Board of County Commissioners's Resolution No. 98-048, shall be
authorized not sooner than fifteen (15) days following publication of this notice. Written
objections or other comment on the proposed private sale shall be accepted through June 2,
1998 and should be directed to Deschutes County Property Management, 1130 NW Harriman
Street, Bend, Oregon 97701. Upon consideration of said written comments, the Board may
act to sell the real property as described to Keith Cyrus or others, byway of a bargain and sale
deed.
