WHEREAS, the Board of County Commissioners of Deschutes County, Oregon, initiated the
vacation of a portion of 3rd Street and a portion of "E" Avenue in Terrebonne, Deschutes County, Oregon
by Resolution Number 98-057 dated on May 27, 1998; and
WHEREAS, at the request of the Board of County Commissioners of Deschutes County, Oregon,
the County Road Official has submitted a report on the proposed vacation pursuant to ORS 368.346;
now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS
as follows:
Section 1. That the report relating to the vacation of a certain dedicated public road known as a
portion of 3rU-S—treet and a portion of "E" Avenue in Terrebonne, described in Exhibit "A", attached hereto
and by this reference incorporated herein, is hereby accepted and hereby approved.
Section 2. That on Wednesday, July 8, 1998, at 10:00 a.m. at the Deschutes County Juvenile
Justice Center, Conference Room "A", Bend, Oregon 97701, the Board will hold a hearing to determine
whether vacation of the subject property, described in Exhibit "B", attached hereto and by this reference
incorporated herein, is in the public interest.
Section 3. Notice of said hearing shall be provided by posting and publication in a form that
substantially conforms with Exhibit "C", attached hereto and by this reference incorporated herein,
pursuant to ORS 368.346(3) and 368.401 to 368.426.

Vacation of a portion of 3rd Street and E Avenue in Terrebonne
This report is made pursuant to ORS 368.326 through 368.366, concerning the vacation of public
road right-of-way.
Background:
Deschutes County received a petition which is attached as "Exhibit 1" from Tim Hitson, Robert
Ventgen, and Jerry Roberts (a representative of Benaiah Chapel Inc.) requesting the vacation of a
public road right-of-way. The requested vacation is for a portion of `B" Avenue between 2nd
Street and 3rd Street and a portion of 3rd Street just to the north and the south of "E" Avenue in
Terrebonne. The legal description of the proposed road vacation is attached as "Exhibit 2". A
map showing the general location of the area proposed for vacation within the Terrebonne
Community is shown as "Exhibit 3". A map showing the location and property ownership
pattern is attached as "Exhibit W.
The petitioners, own the property abutting the north and south sides of `B" and the west and east
sides of 3rd Street. The petitioners are requesting the vacation for the reasons stated in a letter
submitted by Tim Hitson which is attached as "Exhibit 4". His letter basically states that the road
right-of-ways are so steep that roads will never be built or needed there. Also, nobody's existing
access will be restricted and there are no existing utilities in the right-of-way to be vacated.
The proposed vacation lies within the boundaries of the Terrebonne Rural Service Center (RSC).
The section of "E" Avenue to be vacated lies between block 23 and 24 of the Township Plat of
Hillman (Terrebonne). A portion of 3rd Street to be vacated lies north of "E" Avenues between
block 24 and block 31 of the Township Plat of Hillman (Terrebonne) A second portion of 3rd
Street to be vacated lies south of "E" Avenue between block 23 and block 32 of the Township
Plat of Hillman (Terrebonne) The property is zoned TeR Residential district in the Terrebonne
Quality Services Performed with Pride

Rural Community. The four tax lots adjoining the right-of-way proposed for vacation are all
vacant.
Both 3rd Street and "E" Avenue are "paper streets", neither having ever been developed as a
street for travel. There is no evidence of either right-of-way ever being use for road purposes in
the past, probably due to the very steep topography in this area.
The petitioners represent all of the private properties abutting the portions of both 3rd Street and
"B" Avenue proposed in the vacation.
From in -the -field observations of the area, no above ground or overhead utilities exist within
these sections of 3rd street and `B" Avenue. There also was no observable evidence of
underground utilities within this section of right-of-way.
The Road Department mailed preliminary notices of the proposed vacation to the affected
utilities and agencies. Their responses are as follows:
Central Electric Cooperative: No response.
C.O.I. Irrigation District: Rose Helm responded: "The Central Irrigation District has no
objections to the proposed vacation. Thank you."
Falcon Cable TV: No response.
Pacific Gas Transmission Co.: No response.
Terrebonne Water District: Doug McLaughlin responded: "The Terrebonne Water District
has no existing facilities in the right-of-way to be vacated. The District suggests that the owners
of property adjacent to these vacated rights-of-way contact us regarding their future water needs
before vacating right-of-way, as they could end up with a lot that cannot be served water. The
Terrebonne Water District will not install water mains outside of street right-of-ways. Also note
that "Terrebonne Transportation Plan" states that "existing road rights-of-way shall be
preserved."
US West Communications: No response.
Redmond Fire Department: No response.
Deschutes County Community Development: Heidi Kennedy, Associate Planner, responded:
"The Planning Division has received your request for comments on the proposed vacation of
portions of 3rd Street and `B" Avenue.
After reviewing the proposed vacation, it is staff's opinion that vacating the portions of 3rd Street
and `B" Avenue identified in the submitted map will severely limit the amount of potential right-
of-way access to a number of residential zoned lots located along these streets in blocks 23, 24,
31 and 32 of the Hillman (Terrebonne) Plat. The lots in these blocks of the Hillman
(Terrebonne) Plat are zoned TeR - Residential district in the Terrebonne Rural Community.
Deschutes County Planning Division would not recommend approval of this specific matter."

Deschutes County Property Development: Jim Bonnarens responded: Deschutes County does
not own any property that would be affected by this vacation. Thank you."
Deschutes County Legal Counsel: No response.
Findings:
Based on preliminary responses, and the Department's research of the proposed vacation, the
Road Department makes the following findings:
1. The right-of-way proposed for vacation was dedicated to the public for road purposes on the
original plat of Hillman (Terrebonne) recorded and filed with the Crook County Clerk's Office
on November 22, 1909. (Deschutes County was part of Crook County until 1916.)
2. It appears that the vacation process is adequate to amend the plat, however, the partitioners
must also obtain a re -plat of their individual parcels to not leave any original 25 foot wide lots
from the original Hillman Plat without legal frontage on a dedicated street right-of-way. The re -
plat will combine the narrow 25 foot wide platted lots into single platted parcels retaining legal
frontage on dedicated road right-of-ways after the vacation is finalized.
3. Both 3rd Street and "E" Avenue are classified as rural local streets by the Deschutes County
Transportation Plan. The Plan does not show any arterial or collector roads through the area of
the proposed vacation.
4. Surrounding zoning: All of the land bordering and surrounding the road right-of-way
segment to be vacated is zoned TeR - Residential district in the Terrebonne Rural Community.
5 The "E" Avenue right-of-way provides frontage to and directly adjoins property owned by
Tim Hitson. He owns the property on both sides, north and south, of the `B" Avenue, Tax Lots
206 and 211. Both lots have legal frontage and legal access on 2nd Street. "E" Avenue has
never been cleared or constructed and is not passable at present based on a field inspection of this
right -of --way, it appears that this segment of `B" Avenue would be extremely difficult and costly
to construct due to the extremely steep topography of this site.
6. The 3rd Street right-of-way provides frontage to and directly adjoins property owned by Tim
Hitson. He owns the property on the west side of 3rd Street, Tax Lots 206 and 211. Both lots
have legal frontage and legal access on 2nd Street.
7. The 3rd Street right-of-way provides frontage to and directly adjoins property owned by Ron
Ventgen, Tax Lot 225 located on the south side of `B" Avenue east of 3rd Street. This lot has
legal frontage on "E" Avenue. 3rd Street has never been cleared or constructed and is not
passable at present based on a field inspection of this right-of-way. It appears that this segment
of 3rd Street would be very difficult and costly to construct due to the extremely steep
topography of this site.
8. The 3rd Street right-of-way provides frontage to and directly adjoins property owned by the
Benaiah Chapel, Inc., Tax Lot 224 located on the north side of `B" Avenue east of 3rd Street.
This tax lot has legal frontage on "E" Avenue east of 3rd Street. 3rd Street has never been

cleared or constructed and is not passable at present based on a field inspection of this right-of-
way. It appears that this segment of 3rd Street would not be constructed due to the extremely
steep topography of this site.
9. None of the utilities that were notified have reported having any utilities in the right-of-way
proposed for vacation. The Terrebone Water District did state they will not install water mains
outside of dedicated street right-of-ways.
10. DCC 17.36.180 A states: "Each lot or parcel shall abut upon a public road for at least fifty
feet, except for lots or parcels fronting on the bulb of a cul-de-sac, then the minimum frontage
shall be 30 feet." The proposed vacation would technically leave a number of the originally
platted twenty-five foot wide lots without access; even though they have been combined into four
larger tax lots owned by the three owners requesting the vacation. Lots 2, 3 and 4 on block 31;
lots 14 and 15 on block 32; lots 17, 18, and 19 on block 23; lots 29, 30, 31, and 32 on block 24
would all be without legal frontage if the proposed vacation were approved. This situation can
only be rectified by the re -platting of the four tax lots to eliminate these original small lots
created by the original Hillman (Terrebonne) plat.
11. Per ORS 368.366, vacated property shall vest in the owner of the land abutting the vacated
property by extension of the person's abutting property boundaries to the center of the vacated
property.
12. Map D2 Planned Roads of the Terrebonne Rural Community Amendment of the Deschutes
County Comprehensive Plan, which is attached as Exhibit #5, shows no planned streets where
these segments of `B" Avenue and 3rd Street are proposed for vacation due to the steep slopes in
this portion of Terrebonne.
13. Map D3 Planned Pedestrian Improvements of the Terrebonne Rural Community
Amendment of the Deschutes County Comprehensive Plan, which is attached as Exhibit #6,
shows a proposed trail on the alignment of `B" Avenue between 4th Street and 2nd Street. This,
of course, includes the area proposed for vacation in this request. The Terrebonne Rural Service
Center Pedestrian Bicycle and Local Street Plan prepared by David Evans and Associates, Inc. in
January of 1997, projects this trail as a ten foot wide asphalt surface and states on page 27 ".... to
provide logical shortcuts and cost-effective access without resorting to the expense of a full
street. Trails promote pedestrian and bicycle use in keeping with the rural nature of Terrebonne."
The Plan Pedestrian, Bicycle, and Local Street Plan states that the trail may use either public
right -of way or an easement through private property. Retaining a narrower segment of right-of-
way possibly 20 to 30 feet in width or a trail/utility easement would keep the option of a future
trail open.
14. Table D4: Sidewalk & Trail Projects of the Terrebonne Rural Community Amendment of
the Deschutes County Comprehensive Plan, which is attached as Exhibit #7 shows a 700 foot
long trail with stairs for 300 feet at a low priority estimated cost of $21,000 for this segment of
"E" Avenue. Thus, to comply with the plan a right-of-way of 20 to 30 feet in width is required
on "E" Avenue to retain this recommended trail/stair option in the future.
15. The vacation of these segments of `B" Avenue and 3rd Street are in the best interest of the
public as these very steep street right-of-ways will be in private ownership and on the tax roll
rather then in public ownership where no -taxes are paid. A determination first needs to be made

as to the feasibility of the future installation of a future trail and stairs running between 2nd
Street and 4th Street in the right-of-way of "E" Avenue. (See items 13 and 14 above)
16. On page 31 of Exhibit `B" of Terrebonne Rural Community Amendment of the Deschutes
County Comprehensive Plan under Road Network Policies, Policy e) states "Existing road
rights of way shall be preserved." The road Department agrees with this policy where there is
any possibility of extending a road or in this case a trail through the right-of-way at some future
date. The mitigating circumstance with this proposed vacation is the extremely steep terrain that
makes the construction of a local street extremely unlikely. The future construction of a trail and
stairs is called for in the plan on "E" Avenue and thus a right-of-way or trail easement should be
preserved for that possible future improvement.
Deschutes County has maintained a policy of not vacating land which would leave any parcel
without legal frontage on a public road. Therefore, the four tax lots need to be re -plated to
eliminate the narrow lots created in the original plat of Hillman (Terrebonne), some of which
would not have legal access if the vacation is approved.
If, following the public hearing, the Board approves the vacation, the Road Department
recommends imposition of the following conditions of approval:
1. The petitioners are to re -plat the four tax lots to eliminate the originally platted narrow lots
making up their lots.
2. The vacated property shall vest with the abutting property owners in accordance with ORS
368.366.
3. It is the Road Department's assessment that the proposed vacation does not affect any utilities
and is not needed for any future utility facilities. The Road Department recommends that the
right-of-way be vacated without a reservation for utility easements.
4. A thirty foot wide right-of-way or trail easement should be maintained in the existing right-
of-way of "B" Avenue to allow for the future installation of a pedestrian trail and stairs. The
remainder of the sixty foot wide right-of-way could be vacated if the other three recommended
conditions are met.

Deschutes County;
This letter is to give a little bit of explaination concerning my petition to
vacate a road. Regarding the E street vacating; it is very steep and it is
inconceivable that the County would ever put or need a road there. I
would like to have the use of the property without the road easement. I
own the lots on both sides of it.
As for 3rd street, it is also of the same topography. All adjoining
neighbors would like to see this street vacated and nobody's access will
be resticted. All of them have been there for years and have well
established accesses.
There are no existing utilities or easements on the area designated for
vacating.

PS: in the unlikely event that one portion of the road does not meet
whatever criteria it must, I request that the maximum remainder of the
requested area be vacated irregardless with first priority given to E
street.

there is physical evidence of an existing utility on the parcel, or a utility company provides
evidence of an existing facility, or there is a specific request from a utility company to retain an
easement for a planned future facility.
