WHEREAS, ORS 275.100 provides that the Board of County Commissioners shall
declare its intention to exchange real property by proper resolution; and
WHEREAS, a hearing shall be held for the purpose of receiving objections to the
proposed exchange of real property; and
WHEREAS, Deschutes County intends to exchange real property with the State of
Oregon, Oregon Parks and Recreation Department; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
DESCHUTES COUNTY, OREGON, as follows:
Section 1. The real property to be transferred by Deschutes County is generally
described as follows:
Parcel 1
A tract of land located in the Southeast Quarter (SE'/4) of Section Eleven
(11), Township Fourteen (14) South, Range Thirteen (13) East of the
Willamette Meridian, more particularly described as follows:
Beginning at a point whence the South Quarter corner of said Section 11
bears South 43°31'10" West, 2616.64 feet; thence North 37°10'29" West,
59.28 feet; thence North 28°50'52" West, 313.47 feet; thence North
41°17'54" West, 108.65 feet; thence North 89°11'38" West, 471.99 feet;
thence South 17°07'13" East, 238.92 feet; thence South 19°02'14" West,
190.45 feet; thence South 89°45'00" East, 722.29 feet to the point of
beginning;
EXCEPTING THEREFROM that portion within the right of way of
Wallenburg Road;

28°50'52" East, 146.62 feet; thence South 77°07'04" West, 204.98 feet;

South, Range 13 East of the Willamette Meridian, a stone marked with a
cross and 6 inches below the surface of the existing Smith Rock Road;
thence South 89°45' East, 1316.49 feet to the East 1/16 corner between said
Sections 11 and 14, an existing 1/2" reinforcing bar; thence North 0°50'30"
East, 316.00 feet to the point of beginning and existing 1/2" reinforcing bar;
thence from the point of beginning, continuing North 0°50'30" East, 344.00
feet to an existing 3/4" galvanized iron pipe; thence North 89°45' West,
1161.08 feet to a square headed bolt in the Smith Rock Road; thence South
34°48' West, 285.29 feet along the approximate center line of the Smith

The real properties to be transferred by the State of Oregon, Oregon Parks and
Recreation Department are generally described as follows:
Parcel 1
Government Lot 3 and the South 1/2 of the Northwest 1/4 of Section 3,
Township 17S, Range 12E;
Excepting therefrom the parcel of land conveyed to the Oregon Department
of Transportation for road purposes as "Parcel 10" in that Correction Deed
recorded in Volume 258, Page 2232, Deschutes County Official Records, on
February 20, 1992.
Parcel 2:
The Southeast 1/4 of the Southwest 1/4 of Section 34, Township 16S, Range
12E;
Excepting therefrom the parcel of land conveyed to the Oregon Department
of Transportation for road purposes as "Parcel 10" in that Correction Deed
recorded in Volume 258, Page 2232, Deschutes County Official Records, on
February 20, 1992.
Parcel 3
The East 1/2 of the Northeast 1/4 of Section 23, Township 16S, Range 12E;
Excepting therefrom the parcel of land conveyed to the Oregon Department
of Transportation for road purposes as "Parcel 6" in that Correction Deed
recorded in Volume 258, Page 2229, Deschutes County Official Records, on
February 20, 1992.
Real property proposed for exchange by the State of Oregon may be subject to an open
space or conservation easement along US Highway 97.
Section 2. A hearing for the purpose of receiving objections to the above described land
trade will be held at 10:00 a.m. on Wednesday, September 23, 1998, in the Board of County
Commissioners' Hearing Room, 1130 NW Harriman Street, Bend, Oregon.

Section 3. That the Clerk of the County Court shall give notice of the time and place for
the hearing set in Section 2 of this Resolution by publication of the notice marked Exhibit "A,"
attached hereto and by this reference incorporated herein, in The Bulletin once each week for
four consecutive weeks prior to the date of such hearing.

of Transportation for road purposes as "Parcel 6" in that Correction Deed
recorded in Volume 258, Page 2229, Deschutes County Official Records, on
February 20, 1992.
The real property to be transferred by Deschutes County are two residences located adjacent to
Smith Rock State Park.
The real properties to be transferred by the State of Oregon, Oregon are undeveloped acreages
between Bend and Redmond, Oregon, on US Highway 97.
