ORDINANCE NO. 98-066
WHEREAS, Section 18.84.100, Septic permits, of Title 18 of the Deschutes County Code limits
the requirement for site plan review prior to issuance of a septic permit to on-site sewage disposal
systems located within 200 feet of a river or stream in a landscape management corridor; and
WHEREAS, Deschutes County must determine land use compatibility prior to issuance of a
septic permit for any on-site system to be located in any part of a landscape management combining zone
to comply with the state agency coordination program for the Oregon Department of Environmental
Quality; and
WHEREAS, the conflict between the ordinance provision and the DEQ requirements for
issuance of a septic permit may create confusion or lead to errors in the issuance of septic permits; now,
therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ORDAINS as follows:
Section 1. REPEAL. Section 18.84.100, Septic permits, of the Deschutes County Code is
hereby repealed.
Section 2. EFFECTIVE DATE. This Ordinance being necessary for the immediate
preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance
takes effect on its passage.
