1998-53309-Ordinance No. 98-082 Recorded 11/10/1998REVIEWED AS TO FORM 169 '` 2693 REVIEVdED CODE REVIEW COMM: LEGAL COUNSEL BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON 98 NOV 110 PH 2= 19 An Ordinance Amending Title 18, the Deschutes MARY SUE }-'rNHOLLOW County Zoning Map, Changing the Zone Designation For Certain Property and Declaring an Emergency. * COUNTY CLERK ORDINANCE NO. 98-082 WHEREAS, Cascade Pumice, Inc., submitted a request for a quasi-judicial amendment to the Deschutes County Zoning Map to change the zone designation for certain property from EFU-TRB, Exclusive Farm Use-Tumalo Redmond Bend Subzone, to RI, Rural Industrial; and WHEREAS, adoption of the RI zone designation is subject to certain use restrictions to assure compliance with Goal 14, and these restrictions will be fulfilled by use of a Limited Use Combining Zone; and WHEREAS, the Limited Use Combining Zone restricts the use of the subject property to only the storage, crushing, processing, sale and distribution of pumice; and WHEREAS, the Deschutes County Hearings Officer, after review conducted in accordance with applicable law, has approved the proposed zone change to RI, together with a Limited Use Combining Zone and has forwarded the approval as a recommendation; and WHEREAS, after notice was given and hearing conducted according to applicable law, the Board of County Commissioners adopted a goal exception and comprehensive plan amendment for the subject property by Ordinance 98-081; how, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON ORDAINS as follows: Section 1. AMENDMENT. Title 18, the Deschutes County Zoning Map, is amended to change the zone designation for the property described in Exhibit `B" to Ordinance 98-081, incorporated herein by this reference, and shown in Exhibit "A," attached hereto and by this reference incorporated herein, from EFU-TRB Exclusive Farm Use - Tumalo Redmond Bend Subzone, to Rural Industrial, RI, zone. Section 2. AMENDMENT. Title 18, the Deschutes County Zoning Map, is amended to add a Limited Use Combining, LU, zone designation for the property described in Exhibit "B" to Ordinance 98-081, incorporated herein by this reference, and shown in Exhibit "A," attached hereto and by this reference incorporated herein, Section 3.:: FINDINGS. This ordinance is supported by the decision of the Deschutes County Hearings Officer for File No. PA-98-2/ZC-98-1, attached to Ordinance 98-081 as Exhibit "E," and incorporated herein by this reference.
