ORDER NO. 98-172 WHEREAS, an election was held November 3, 1998, regarding the formation of the Deschutes Public Library District and election of an initial Board of Directors as set forth in Exhibit A; and WHEREAS, more than 50% of those voting voted in favor of formation of the district and the permanent rate limit for ad valorem taxes, as set forth in the certification of election, attached hereto as Exhibit B and incorporated herein by reference; and WHEREAS, an election was held for an initial Board of Directors and, upon canvassing the votes, it appears, from the certification of election, attached hereto as Exhibit B, that pursuant to ORS 357.231, five candidates, representing each of the five zones as set forth on Exhibit C, were elected to the initial Board of the District; and WHEREAS, the election also established a permanent rate limit of $0.55 per $1,000 assessed value for ad valorem taxes; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. That at the election held in Deschutes County, Oregon, on November 3, 1998, 24,669 electors voted YES and 13,696 electors voted NO on the measure captioned "9-60 To Form Library District and Establish Permanent Tax Rate Limitation," set forth in Exhibit A, attached hereto and by this reference incorporated herein, as evidenced by the certification of votes marked Exhibit B, attached hereto and by this reference incorporated herein; and that the measure forming the Deschutes Public Library District is declared to have passed. Section 2. That the district, named the Deschutes Public Library District, having the boundaries described in Exhibit D, attached hereto and by this reference incorporated herein, and depicted on the map marked Exhibit E, attached hereto and by this reference incorporated herein, is hereby declared to be formed. The purpose of the Deschutes Public Library District is to provide library services as a library district organized under ORS 357.216 to 356.286. Section 4. That a permanent rate limit for the Deschutes Public Library District of $0.55 per $1,000 assessed value for ad valorem taxes pursuant to Section 11, Article 11, Oregon Constitution is hereby established. Section 5 That the Clerk shall issue certificates of election to the following individuals as members of the initial Board of Directors: Patricia J. Lawrence, 3,586 votes, Zone 1 for a one-year term; Mary Beth Pearl, 4,277 votes, Zone 2 for a three-year term; George C. Riser, 4,340 votes, Zone 3 for a three-year term; Raymond Miao, 3,610 votes, Zone 4 for a one-year term; and Ann H. Evensen, 4,379, Zone 5 votes for a one-year term, who are hereby declared to be elected. QUESTION: Shall Deschutes Pub- lic Library District be formed and C YES impose $0.55 per $1,000 assessed value as permanent rate limit be- ginning 1998-99? CC NO SUMMARY: This measure will form the Deschutes Public Library District. Deschutes County intends to transfer all county library services to the dis- trict and cease library funding from its general fund. The new library district will be separate from Deschutes County. The new district will have its own tax rate dedicated to library purposes. Stable funding will restore and expand services in branch libraries in Bend, La Pine, Redmond, Sis- ters and Sunriver. Funding will provide children's programs, double new books and expand open hours. The new library district will be governed by an independent elected board. The five board mem- bers will be elected from zones.
