ORDER NO. 98-200
WHEREAS, ORS 275.100 provides that Deschutes County may exchange real property
with another governmental body when it deems such exchange to be in the best interest of
Deschutes County; and
WHEREAS, the Board of County Commissioners of Deschutes County did adopt
Resolution No. 98-097 providing for a hearing for the exchange of real property between
Deschutes County and Oregon Park and Recreation Department; and
WHEREAS, said hearing was held on September 23, 1998; and
WHEREAS, the Board of County Commissioners finds that the real property generally
described herein, is equal; and
WHEREAS, the Board of County Commissioners finds that the exchange of the real
property herein described is in the best interest of Deschutes County; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, AUTHORIZES AND ORDERS as follows:
Section 1. The real property to be transferred by Deschutes County is generally
described as follows:
Parcel 1•
A tract of land located in the Southeast Quarter (SEl/a) of Section Eleven (11),
Township Fourteen (14) South, Range Thirteen (13) East of the Willamette
Meridian, more particularly described as follows:
Beginning at a point whence the South Quarter corner of said Section 11 bears
South 43°31'10" West, 2616.64 feet; thence North 37°10'29" West, 59.28 feet;
thence North 28°50'52" West, 313.47 feet; thence North 41°17'54" West, 108.65

land lying and being in Crooked River Acres (unrecorded), Lot 1, also situated
in Southeast 1/4 of said Section 11, more particularly described as follows:
Starting at the Northeast corner of said Lot 1, the initial point, as well as the
point of beginning; thence South 41°17'54" East, 108.65 feet; thence South
28°50'52" East, 146.62 feet; thence South 77°07'04" West, 204.98 feet; thence
North 12°02'28" West, 237.41 feet; thence North 89°11'38" West, 357.89 feet;
thence North 17°07'13" West, 26.27 feet; thence South 89°11'38" East, 471.99
feet to the point of beginning;
EXCEPT that portion lying within the right of way of Wallenburg Road.

Range 13 East of the Willamette Meridian, a stone marked with a cross and 6
inches below the surface of the existing Smith Rock Road; thence South 89°45'
East, 1316.49 feet to the East 1/16 corner between said Sections 11 and 14, an
existing 1/2" reinforcing bar; thence North 0°50'30" East, 316.00 feet to the point
of beginning and existing 1/2" reinforcing bar; thence from the point of
beginning, continuing North 0°50'30" East, 344.00 feet to an existing 3/4"
galvanized iron pipe; thence North 89°45' West, 1161.08 feet to a square headed
bolt in the Smith Rock Road; thence South 34°48' West, 285.29 feet along the
approximate center line of the Smith Rock Road to a square headed bolt;
thence South 0°18'30" West, 109.01 feet along the approximate center line of the
Smith Rock Road to a square headed bolt; thence South 89°45' East on a line
parallel with the South line of said Section 11, a distance of 1319.43 feet to the
point of beginning;
Subject to the right-of-way of Wallenburg Road; and
EXCEPTING THEREFROM the East 633 feet.
The real properties to be transferred by the State of Oregon, Oregon Parks and
Recreation Department are generally described as follows:
Parcel 1:
Government Lot 3 and the South 1/2 of the Northwest 1/4 of Section 3,
Township 17S, Range 12E;
Excepting therefrom the parcel of land conveyed to the Oregon Department of
Transportation for road purposes as "Parcel 10" in that Correction Deed
recorded in Volume 258, Page 2232, Deschutes County Official Records, on
February 20, 1992.
Parcel 2:
The Southeast 1/4 of the Southwest 1/4 of Section 34, Township 165, Range
12E;
Excepting therefrom the parcel of land conveyed to the Oregon Department of
Transportation for road purposes as "Parcel 10" in that Correction Deed
recorded in Volume 258, Page 2232, Deschutes County Official Records, on
February 20, 1992.
Parcel 3:
The East 1/2 of the Northeast 1/4 of Section 23, Township 165, Range 12E;

Excepting therefrom the parcel of land conveyed to the Oregon Department of
Transportation for road purposes as "Parcel 6" in that Correction Deed
recorded in Volume 258, Page 2229, Deschutes County Official Records, on
February 20, 1992.
Real property proposed for exchange by the State of Oregon may be subject to an open
space or conservation easement along US Highway 97.
Section 2. That upon review and approval of title by the Deschutes County Legal
Counsel the exchange of real property as referenced is hereby authorized.
Section 3. The Deschutes County Legal Counsel is authorized to take those actions
reasonably calculated to fulfill the referenced exchange and the Board of County
Commissioners is authorized to sign deeds and documents necessary to complete this exchange
without further action.
