WHEREAS, pursuant to ORS 810.180 paragraph (8), Section(a), the Board of County
Commissioners as a road authority have been delegated authority by the Oregon Department of
Transportation designate reasonable and safe speeds on low volume or not hard surfaced County roads.
In the Board's judgment, to protect the safety of the public; and
WHEREAS, this action is based upon an engineering and traffic investigation; and
WHEREAS, SW 73rd Street lies outside the corporate limits of any city; and
WHEREAS, it appears that a safety necessity exists on SW 73rd Street; now therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES
COUNTY, OREGON as follows:
Section 1. The designated speed of 35 m.p.h. be assigned to the following section of SW
73`d Street from Gift Road to Limestone Avenue in Whispering Pines Subdivision.
Section 2. That the County Road official erect appropriate signing according to MUTCD
(Manual of Uniform Traffic Control Devices) requirements giving notice of the restriction.
Section 3. That any previous order with respect to the designated speed for the above road
which is in conflict with the provisions of this order's hereby rescinded.

Deschutes County received a request from some residents of the 73rd Street and
Limestone LIDS to change the Basic Rule speed (55 mph) to a 35 mph speed zone for a
portion of SW 73rd Street. This portion of SW 73rd Street runs from Gift Road south to
Limestone Avenue, a distance of 0.6 miles. SW 73rd Street is located in Whispering
Pines Estates between Bend and Redmond.
The Road Department forwarded the speed zone request to the Deschutes County
Sheriff's Department. Sergeant John Diehl of the Sheriff's Department agreed with the
residents' recommendation that the speed zone on SW 73rd Street should be reduced to 35
mph. John's reason for this recommendation is "Bridge Drive is a residential road with
curves and a speed zone will make for more consistent enforcement than possible with a
VBR."
Deschutes County has been delegated authority to establish speed zoning on low volume
(less than 500 ADT) and/or unpaved County roads. This authority was granted under the
condition that the County follows the engineering principles of and the criteria adopted
by ODOT for the investigation and establishment of speed zones.
The Road Department completed the speed studies (see attached) and recommends that
the Deschutes County Board of Commissioners establish a 35 mph speed zone on SW
73rd Street. The Road Department's recommendation is based on the volume of traffic,
existing traffic speeds, and number of accidents. If the Board establishes the speed zone
the Road Department will install the speed signs on these roads as soon as possible.
