Culver II and Sandra M. Culver (the Culver Property); and WHEREAS, ORS 275.100 provides that the Board of County Commissioners shall declare its intention to exchange real property by proper resolution; and WHEREAS, a hearing shall be held for the purpose of receiving objections to the proposed exchange of real property; and WHEREAS, Central Electric Cooperative, Inc. desires to exchange certain real property it owns with Deschutes County and will pay Deschutes County $10,000.00 to make up difference in properties being exchanged to acquire the Culver Property being acquired by the County; and WHEREAS, Deschutes County and Central Electric Cooperative, Inc. intend to conduct an exchange of real property; now, therefore, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. That Deschutes County acquire the Culver Property, described as Parcel 1 in Section 2 of this Resolution. Section 2. That Deschutes County intends to transfer to Central Electric Cooperative, Inc., real property generally described as: Parcel 1 The East Half of the Northwest One -Quarter of the Northeast One -Quarter (E'/z NWIA NE'/4) of Section Twenty-four (24), Township Seventeen (17) South, Range Twelve (12), East of the Willamette Meridian, Deschutes County, Oregon; The real property to be transferred to Deschutes County by Central Electric Cooperative, Inc. is generally described as follows: Parcel 2 PAGE 1 OF 3 - RESOLUTION NO. 99,021 (3/10/99) A tract of land containing 11.3 acres, more or less, located in the Southwest one-quarter of the Southeast one-quarter (SW'/4SE'/a) of Section Fourteen (14), Township Eighteen (18) South, Range Twelve (12) East of the Willamette Meridian, Deschutes County, Oregon, being more particularly described as follows: The Southerly 900 feet of the Easterly 660 feet of the Southwest one-quarter of the Southeast one-quarter (SW'/aSE'/a) of said Section 14. EXCEPTING THEREFROM: A tract of land described as follows: Beginning at the Southeast corner of the Southwest one-quarter of the Southeast one-quarter (SW'/4SE'/4) of said Section 14; thence North 88059'18" West along the South line of said Section 14 a distance of 303.08 feet to the Easterly right-of-way line of the Bonneville Power Transmission Line; thence North 24054'43" East along said Easterly right-of-way line a distance of 719 feet, more or less, to the East line of the Southwest one-quarter of the Southeast one-quarter (SW'/aSE'/4) of said Section 14; thence Southerly along said East line a distance of 658 feet, more or less, to the point of beginning. Section 3. A hearing for the purpose of receiving objections to the above exchange of real property will be held at 10:00 a.m. on Wednesday, April 14, 1999, in the Board of County Commissioners Hearing Room of the Deschutes County Administration Building, 1130 NW Harriman, Bend, Oregon. Section 4. That the Clerk of the County Court shall give notice of the time and place for the hearing set in Section 3 of this Resolution by posting in three public places and by publication of the notice marked Exhibit 'A" attached hereto and by this reference incorporated herein, in "The Bulletin' once each week for four consecutive weeks prior to the date of such hearing.
